An act relating to duty of candor to alleged victims; 2
creating s. 960.0023, F.S.; requiring certain persons 3
to disclose their identity and, if representing or 4
working on behalf of another, the identity of that 5
other person and his or her relation to that person 6
when contacting an alleged victim of a crime or a 7
delinquent act to obtain information relating to the 8
alleged victim or the crime or delinquent act; 9
providing criminal penalties; providing an effective 10
date. 11

Be It Enacted by the Legislature of the State of Florida: 13

Section 1. Section 960.0023, Florida Statutes, is created 15
to read: 16
960.0023 Duty of candor to an alleged victim. —A person who 17
has been arrested or charged with a crime or a delinquent act, 18
as well as that person's attorney or agent, who contacts the 19
alleged victim to obtain information relating to the alleged 20
victim of the crime or delinquent act must disclose his or her 21
identity and, in the case of an attorney or agent, the identity 22
of the person he or she represents or on whose behalf he or she 23
is working and his or her relation to that person. A person who 24
violates this section commits a misdemeanor of the second 25

degree, punishable as provided in s. 775.082 or s. 775.083. 26
Section 2. This act shall take effect October 1, 2023. 27
