2323 Be It Enacted by the Legislature of the State of Florida: 10

2525 Section 1. (1) The Department of Environmental Protection 12
2626 shall conduct a study on the disposal of food waste materials 13
2727 and submit a report to the President of the Senate and the 14
2828 Speaker of the House of Representatives on or before July 1, 15
2929 2024. 16
3030 (2) The study must: 17
3131 (a) Determine the current impact of the disposal of food 18
3232 waste materials in landfills and at solid waste facilities. 19
3333 (b) Determine what composting facilities, anaerobic 20
3434 digestion facilities, and other recycling facilities currently 21
3535 exist in the state with the capacity t o accept food waste 22
3636 materials. 23
3737 (c) Examine the current cost of the disposal of food waste 24
3838 materials in landfills and at solid waste facilities versus the 25

5252 facilities, anaerobic digestion facilitie s, and other recycling 27

5454 (d) Provide legislative recommendations on the feasibility 29
5555 of a pilot program to require food outlets, food service 30
5656 establishments, schools or other educational facilities, and 31
5757 businesses to recycle food waste materials and the most 32
5858 efficient method to accomplish the goal of redirecting the 33
5959 disposal of food waste materials in landfills and at solid waste 34
6060 facilities to composting facilities, anaerobic digestion 35
6161 facilities, and other recycling facilities. The department ma y 36
6262 provide legislative recommendations for additional goals of the 37
6363 pilot program. 38
6464 (e) Provide legislative recommendations for educational 39
6565 materials on the benefits of alternative food disposal methods. 40
6666 (f) Determine the type and size of food outlets, fo od 41
6767 service establishments, schools or other educational facilities, 42
6868 and businesses that should participate in the pilot program 43
6969 under paragraph (d). 44
7070 (3) For the 2023-2024 fiscal year, the nonrecurring sum of 45
7171 $100,000 from the General Revenue Fund is appr opriated to the 46
7272 department for the purpose of conducting a study on the disposal 47
7373 of food waste materials pursuant to this section. 48
7474 Section 2. This act shall take effect July 1, 2023. 49
