(1) The Department of Environmental Protection 12 shall conduct a study on the disposal of food waste materials 13 and submit a report to the President of the Senate and the 14 Speaker of the House of Representatives on or before July 1, 15 2024. 16 (2) The study must: 17 (a) Determine the current impact of the disposal of food 18 waste materials in landfills and at solid waste facilities. 19 (b) Determine what composting facilities, anaerobic 20 digestion facilities, and other recycling facilities currently 21 exist in the state with the capacity t o accept food waste 22 materials. 23 (c) Examine the current cost of the disposal of food waste 24 materials in landfills and at solid waste facilities versus the 25 HB 739 2023 CODING: Words stricken are deletions; words underlined are additions. hb0739-00 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S cost of the disposal of food waste materials at composting 26 facilities, anaerobic digestion facilitie s, and other recycling 27 facilities. 28 (d) Provide legislative recommendations on the feasibility 29 of a pilot program to require food outlets, food service 30 establishments, schools or other educational facilities, and 31 businesses to recycle food waste materials and the most 32 efficient method to accomplish the goal of redirecting the 33 disposal of food waste materials in landfills and at solid waste 34 facilities to composting facilities, anaerobic digestion 35 facilities, and other recycling facilities. The department ma y 36 provide legislative recommendations for additional goals of the 37 pilot program. 38 (e) Provide legislative recommendations for educational 39 materials on the benefits of alternative food disposal methods. 40 (f) Determine the type and size of food outlets, fo od 41 service establishments, schools or other educational facilities, 42 and businesses that should participate in the pilot program 43 under paragraph (d). 44 (3) For the 2023-2024 fiscal year, the nonrecurring sum of 45 $100,000 from the General Revenue Fund is appr opriated to the 46 department for the purpose of conducting a study on the disposal 47 of food waste materials pursuant to this section. 48 Section 2. This act shall take effect July 1, 2023. 49
