An act relating to the Hernando County School 2
District, Hernando County; providing legislative 3
findings; repealing the School Board of Hernando 4
County resolution which provides for an appointed 5
superintendent of schools; providing for an elected 6
superintendent of schools; requiring a referendum; 7
providing an effective date. 8

Be It Enacted by the Legislature of the State of Florida: 10

Section 1. Findings of fact.—The Legislature finds that 12
the School Board of Hernando County adopted a resolution to 13
change the position of the Hernando County Superintendent of 14
Schools from an elected position to an appointed position and 15
that such resolution wa s approved by the electorate during the 16
March 10, 1992, presidential preference primary. 17
Section 2. Repeal of resolution. —Pursuant to Section 5, 18
Article IX of the State Constitution, the resolution described 19
in section 1 is repealed. The Hernando Count y Superintendent of 20
Schools shall be elected in a partisan election to a term of 4 21
years by vote of the qualified electors residing in Hernando 22
County, beginning with the general election in 2028. 23
Section 3. Referendum election. — 24
(1) As required by S ection 5, Article IX of the State 25

Constitution, during the 2024 primary election, there shall be 26
held a referendum election concerning whether section 2 shall 27
become a law. 28
(2) The ballot title for the referendum question shall be 29
in substantially the fo llowing form: 30
REPEALING RESOLUTION PROVIDING FOR AN APPOINTED, RATHER 31
THAN AN ELECTED, SUPERINTENDENT OF SCHOOLS 32
(3) The referendum question shall be placed on the ballot 33
in substantially the following form: 34
Currently, by resolution, the Hernando County School Board 35
provides for an appointed Superintendent of Schools for 36
the Hernando County School District. Shall Chapter 2023 - 37
, Laws of Florida, which repeals the Hernando County 38
School Board Resolution and provides that the 39
Superintendent of Schools shal l no longer be appointed by 40
the School Board, but shall be elected in a partisan 41
election for a term of four years, beginning with the 2028 42
General Election, become effective? 43
( ) Yes. 44
( ) No. 45
(4) The referendum election shall be conducted by the 46
Supervisor of Elections of Hernando County in accordance with 47
the Florida Election Code. 48
Section 4. This act shall take effect upon becoming a law, 49
except that section 2 shall take effect only up on approval by a 50

majority vote of those qualified electors of Hernando County 51
voting in a referendum to be held in conjunction with the 2024 52
