A bill to be entitled 1 
An act relating to public records and meetings; 2 
creating s. 468.1336, F.S.; providing an exemption 3 
from public meetings requirements for certain portions 4 
of meetings of the Audiology and Speech -language 5 
Pathology Interstate Compact Commission and its 6 
executive committee; providing an exemption from 7 
public records requirements for recordings, minutes, 8 
and records generated during exempt portions of such 9 
meetings; providing for future legislative review and 10 
repeal of the exemptions; providing statements of 11 
public necessity; providing a contingent effective 12 
date. 13

Be It Enacted by the Legislature of the State of Florida: 15 
 16 
 Section 1.  Section 468.1336, Flori da Statutes, is created 17 
to read: 18 
 468.1336  Audiology and Speech -language Pathology 19 
Interstate Compact Commission; public meetings and public 20 
records exemptions.— 21 
 (1)  Any portion of a meeting of the Audiology and Speech -22 
language Pathology Interstate Comp act Commission or its 23 
executive committee in which any of the following information is 24 
discussed is exempt from s. 286.011 and s. 24(b), Art. I of the 25

State Constitution: 26 
 (a)  Noncompliance of a member state with its obligations 27 
under the compact; 28 
 (b)  The employment, compensation, discipline, or other 29 
matters, practices, or procedures related to specific employees 30 
or other matters related to the commission's internal personnel 31 
practices and procedures; 32 
 (c)  Current, threatened, or reasonably anticipated 33 
litigation; 34 
 (d)  Negotiation of contracts for the purchase, lease, or 35 
sale of goods, services, or real estate; 36 
 (e)  Accusing any person of a crime or formally censuring 37 
any person; 38 
 (f)  Trade secrets or commercial or financial information 39 
that is privileged or confidential; 40 
 (g)  Information of a personal nature if disclosure would 41 
constitute a clearly unwarranted invasion of personal privacy; 42 
 (h)  Investigative records compiled for law enforcement 43 
purposes; 44 
 (i)  Information relating to any investigat ive reports 45 
prepared by or on behalf of or for use by the commission or 46 
executive committee when investigating or determining compliance 47 
with the compact; or 48 
 (j)  Matters specifically exempted from disclosure by 49 
federal or state practice laws. 50

 (2)  Recordings, minutes, and records generated during any 51 
portion of an exempt meeting are exempt from s. 119.07(1) and s. 52 
24(a), Art. I of the State Constitution. 53 
 (3)  This section is subject to the Open Government Sunset 54 
Review Act in accordance with s. 119 .15 and shall stand repealed 55 
on October 2, 2028, unless reviewed and saved from repeal 56 
through reenactment by the Legislature.  57 
 Section 2.  (1)  The Legislature finds that it is a public 58 
necessity that any portion of a meeting of the Audiology and 59 
Speech-language Pathology Interstate Compact Commission or its 60 
executive committee in which any information in s. 468.1336(1), 61 
Florida Statutes, is discussed be made exempt from s. 286.011, 62 
Florida Statutes, and s. 24(b), Article I of the State 63 
Constitution. 64 
 (2)  The Audiology and Speech -language Pathology Interstate 65 
Compact requires that any portion of a meeting in which any 66 
information in s. 468.1336(1), Florida Statutes, is discussed be 67 
closed to the public. In the absence of a public meetings 68 
exemption, this state would be prohibited from becoming a member 69 
state of the compact. Thus, this state would be unable to 70 
effectively and efficiently administer the compact. 71 
 (3)  The Legislature also finds that it is a public 72 
necessity that the recordings, minutes, an d records generated 73 
during any portion of a meeting in which any information in s. 74 
468.1336(1), Florida Statutes, is discussed be made exempt from 75

s. 119.07(1), Florida Statutes, and s. 24(a), Article I of the 76 
State Constitution. Release of such informatio n would negate the 77 
public meetings exemption. As such, the Legislature finds that 78 
the public records exemption is a public necessity.  79 
 Section 3.  This act shall take effect on the same date 80 
that HB 877 or similar legislation takes effect , if such 81 
legislation is adopted in the same legislative session or an 82 
extension thereof and becomes law. 83
