An act relating to trespassing; amending s. 810.011, 2
F.S.; redefining the term "posted land" to include 3
land classified as agricultural which has no 4
trespassing signs placed at specified points; 5
providing an effective date. 6

Be It Enacted by the Legislature of the State of Florida: 8

Section 1. Paragraph (a) of subsection (5) of section 10
810.011, Florida Statutes, is amended to read: 11
810.011 Definitions. —As used in this chapter: 12
(5)(a) "Posted land" is that land upon which any of the 13
following signs or notices are placed : 14
1. Signs are placed not more than 500 feet apart along , 15
and at each corner of , the boundaries of the land or, for land 16
classified as agricultural pursuant to s. 193.461, signs placed 17
at each point of ingress and at each corner of the boundaries of 18
the agricultural land which , upon which signs there appears 19
prominently display, in letters of not less than 2 inches in 20
height, the words "No Trespassing" and in addition thereto the 21
name of the owner, lessee, or occupant of the said land. The 22
Said signs must shall be placed along the boundary line of 23
posted land in a manner and in such position as to be clearly 24
noticeable from outside the bou ndary line; or 25

2.a. A conspicuous no trespassing notice is painted on 26
trees or posts on the property, provided that the notice is: 27
(I) Painted in an international orange color and 28
displaying the stenciled words "No Trespassing" in letters no 29
less than 2 inches high and 1 inch wide either vertically or 30
horizontally; 31
(II) Placed so that the bottom of the painted notice is 32
not less than 3 feet from the ground or more than 5 feet from 33
the ground; and 34
(III) Placed at locations that are readily visible to any 35
person approaching the property and no more than 500 feet apart 36
on agricultural land. 37
b. When a landowner uses the painted no trespassing 38
posting to identify a no trespassing "no trespassing" area, 39
those painted notices must shall be accompanied by signs 40
complying with subparagraph 1. and placed conspicuously at all 41
places where entry to the property is normally expected or known 42
to occur. 43
Section 2. This act shall take effect July 1, 2023. 44
