30-Be It Enacted by the Legislature of the State of Florida: 17

32- Section 1. Subsections (4) and (5) of section 286.29, 19
33-Florida Statutes, are amended to read: 20
34- 286.29 Climate-friendly public business. —The Legislature 21
35-recognizes the importance of leadersh ip by state government in 22
36-the area of energy efficiency and in reducing the greenhouse gas 23
37-emissions of state government operations. The following shall 24
38-pertain to all state agencies when conducting public business: 25

51- (4) When procuring new vehicles, all s tate agencies, state 26
52-universities, community colleges, and local governments that 27
53-purchase vehicles under a state purchasing plan shall first 28
54-define the intended purpose for the vehicle and determine which 29
55-of the following use classes for which the vehicle is being 30
56-procured: 31
57- (a) State business travel, designated operator; 32
58- (b) State business travel, pool operators; 33
59- (c) Construction, agricultural, or maintenance work; 34
60- (d) Conveyance of passengers; 35
61- (e) Conveyance of building or maintenance materials and 36
62-supplies; 37
63- (f) Off-road vehicle, motorcycle, or all -terrain vehicle; 38
64- (g) Emergency response; or 39
65- (h) Other. 40

67-Vehicles described in paragraphs (a) through (h), when being 42
68-processed for purchase or leasing agreements, must be selected 43
69-based on the lowest lifetime ownership costs, including costs 44
70-for operations, maintenance, and fuel when fuel economy data is 45
71-available, for the greatest fuel efficiency available for a 46
72-given use class when fuel economy data are available . Exceptions 47
73-may be made for individual vehicles in paragraph (g) when 48
74-accompanied, during the procurement process, by documentation 49
75-indicating that the operator or operators will exclusively be 50
51+universities, community colleges, and local governments that 26
52+purchase vehicles under a state purchasing plan shall first 27

89-exceptional vehicle performan ce characteristics. Any request for 52
90-an exception must be approved by the purchasing agency head and 53
91-any exceptional performance characteristics denoted as a part of 54
92-the procurement process prior to purchase. 55
93- (5) If a state agency purchases a vehicle with an internal 56
94-combustion engine, the state agency must All state agencies 57

98-combustion engines shall procure biofuels for fleet needs to the 61

101-Management Services shall make recommendations to state 64
102-agencies, state universities, community colleges, and loc al 65
103-governments regarding the procurement of electric and natural 66
104-gas fuel vehicles and other vehicles powered by renewable energy 67
105-as defined in s. 366.91(2), Florida Statutes, and best practices 68
106-for integrating such vehicles into existing fleets. 69
107- Section 3. This act shall take effect July 1, 2023. 70
