HB 1107 2023 CODING: Words stricken are deletions; words underlined are additions. hb1107-00 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to continuing chiropractic education; 2 amending s. 460.408, F.S.; deleting a requirement that 3 chiropractic continuing education be completed in a 4 classroom setting; prohibiting the board from limiting 5 the number of hours of continuing education courses a 6 chiropractic physician may complete through distance 7 learning; authorizing the board to make exceptions to 8 meet continuing education requirements d uring a 9 declared state of emergency; specifying who may teach 10 board-approved continuing education courses; requiring 11 the board to adopt rules; providing an effective date. 12 13 Be It Enacted by the Legislature of the State of Florida: 14 15 Section 1. Section 460.408, Florida Statutes, is amended 16 to read: 17 460.408 Continuing chiropractic education. — 18 (1) The board shall require licensees to periodically 19 demonstrate their professional competence as a condition of 20 renewal of a license by completing up to 4 0 contact classroom 21 hours of continuing education. 22 (a) Continuing education courses sponsored by chiropractic 23 colleges whose graduates are eligible for examination under any 24 provision of this chapter may be approved upon review by the 25 HB 1107 2023 CODING: Words stricken are deletions; words underlined are additions. hb1107-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S board if all other requirements of board rules setting forth 26 criteria for course approval are met. 27 (b) The board shall approve those courses that build upon 28 the basic courses required for the practice of chiropractic 29 medicine, and the board may also approve courses in adju nctive 30 modalities. Courses that consist of instruction in the use, 31 application, prescription, recommendation, or administration of 32 a specific company's brand of products or services are not 33 eligible for approval. 34 (c) The board may not limit the number of approved 35 continuing education hours that may be completed through 36 distance learning. 37 (2) The board may provide exceptions to make exception 38 from the requirements of this section in emergency or hardship 39 cases and during a declared state of emergency in the state. 40 (3) Courses shall be taught by a speaker or lecturer with 41 at least one of the following qualifications: 42 (a) Holds a post-graduate degree, or bachelor's degree 43 with at least 2 years' experience in the subject matter taught; 44 (b) Is a current faculty member of a chiropractic college 45 or school maintaining a standard and reputability approved by 46 the board or is a current faculty member at a medical or 47 osteopathic college or a university accredited by, or having 48 status with, an agency or its suc cessors recognized and approved 49 by the United States Office of Education or the Council on Post -50 HB 1107 2023 CODING: Words stricken are deletions; words underlined are additions. hb1107-00 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Secondary Accreditation; or 51 (c) Is a post-graduate level instructor of a chiropractic 52 college or school maintaining a standard and reputability 53 approved by the board, or a post-graduate level instructor at a 54 medical or osteopathic college or a university accredited by, or 55 has status with, an agency or its successor which is recognized 56 and approved by the United States Department of Education or the 57 Office of Post-Secondary Education. 58 (4)(3) The board shall may adopt rules required to 59 implement within the requirements of this section that are 60 necessary for its implementation . 61 Section 2. This act shall take effect July 1, 2023. 62
