97 | 97 | | until such time as a preliminary investigation has been 60 |

98 | 98 | | concluded with the finding that there is probable cause to 61 |
---|
99 | 99 | | proceed and a complaint is filed. Prior to d isclosing any 62 |
---|
100 | 100 | | investigatory or disciplinary information concerning a teacher 63 |
---|
101 | 101 | | received from another member state, the commissioner or the 64 |
---|
102 | 102 | | Florida Department of Education shall communicate its intention 65 |
---|
103 | 103 | | and purpose for such disclosure to the member state tha t 66 |
---|
104 | 104 | | originally provided that information. For the purpose of this 67 |
---|
105 | 105 | | subsection, an investigation shall be considered active as long 68 |
---|
106 | 106 | | as it is continuing with a reasonable, good faith anticipation 69 |
---|
107 | 107 | | that an administrative finding will be made in the foreseeable 70 |
---|
108 | 108 | | future. 71 |
---|
109 | 109 | | (4) This section is subject to the Open Government Sunset 72 |
---|
110 | 110 | | Review Act in accordance with s. 119.15 and shall stand repealed 73 |
---|
111 | 111 | | on October 2, 2028, unless reviewed and saved from repeal 74 |
---|
112 | 112 | | through reenactment by the Legislature. 75 |

138 | 138 | | (2) The Legislature finds that it is a pub lic necessity 89 |

139 | 139 | | that records relating to an investigation of a teacher received 90 |
---|
140 | 140 | | from another member state by the commissioner, as defined in s. 91 |
---|
141 | 141 | | 1012.993, Florida Statutes, or the Florida Department of 92 |
---|
142 | 142 | | Education pursuant to the Interstate Teacher Mobility Com pact be 93 |
---|
143 | 143 | | made exempt from s. 119.07(1), Florida Statutes, and s. 24(a), 94 |
---|
144 | 144 | | Article I of the State Constitution, until such time as the 95 |

---|
170 | 170 | | portion of a meeting in which any information in s. 109 |

171 | 171 | | 1012.9931(1), Florida Statutes, is discussed be made exempt from 110 |

172 | 172 | | s. 119.07(1), Florida Statutes, and s. 24(a), Article I of the 111 |

173 | 173 | | State Constitution. Release of such information would negate the 112 |
---|
174 | 174 | | public meetings exemption. As such, the Legislature finds that 113 |

175 | 175 | | the public records exemption is a public necessity. 114 |
---|
176 | 176 | | Section 3. This act shall take effect on the same date 115 |
---|
177 | 177 | | that HB 1125 or similar legislation takes effect , if such 116 |
---|
178 | 178 | | legislation is adopted in the same legislative session or an 117 |
---|
179 | 179 | | extension thereof and becomes law. 118 |
