23 | 23 | | Section 1. Subsection (4) of section 11 of chapter 71 -924, 12 |

26 | 26 | | Section 11. Powers. —The Sanford Airport Authority shall 15 |
---|
27 | 27 | | have the following powers: 16 |
---|
28 | 28 | | (4) To acquire property, real and personal, for the 17 |
---|
29 | 29 | | purpose of establishing, constructing, enlarging, managing, and 18 |
---|
30 | 30 | | operating airports, runways, navigational facilities, buildings, 19 |
---|
31 | 31 | | structures, industrial parks, passenger terminals, fuel storage 20 |
---|
32 | 32 | | facilities, roadways, taxiwa ys, utility systems, and all other 21 |
---|
33 | 33 | | facilities and improvements necessary or desirable for the 22 |
---|
34 | 34 | | servicing of aircraft, the comfort and accommodation of air 23 |
---|
35 | 35 | | travelers, and the operation of said airport facilities for both 24 |
---|
36 | 36 | | foreign and domestic air transportati on. 25 |

47 | 47 | | (a) The authority may acquire by the power of eminent 26 |
---|
48 | 48 | | domain land and the improvements thereon only for public airport 27 |
---|
49 | 49 | | purposes in the manner provided by chapters 73 and 74, Florida 28 |
---|
50 | 50 | | Statutes, and other applicable laws. In addition to acquiring 29 |
---|
51 | 51 | | land for airport purposes by eminent domain, the authority may 30 |
---|
52 | 52 | | also acquire land and other property for airport purposes by 31 |
---|
53 | 53 | | grant, donation, purchase, or lease in the manner otherwise 32 |
---|
54 | 54 | | provided in this act for other projects. 33 |
---|
55 | 55 | | (b) The authority may establish suc h rates, charges, and 34 |
---|
56 | 56 | | user fees for use of airports and airport facilities as the 35 |
---|
57 | 57 | | authority deems necessary. 36 |
---|
58 | 58 | | (c) The authority may also construct or provide for the 37 |
---|
59 | 59 | | construction of such special purpose facilities as are usually 38 |
---|
60 | 60 | | provided for the repair an d servicing of aircraft and for the 39 |
---|
61 | 61 | | comfort and convenience of the public, including but not limited 40 |
---|
62 | 62 | | to fueling equipment and storage, concessions, restaurants, food 41 |
---|
63 | 63 | | and beverage facilities, hotels and other lodging facilities, 42 |
---|
64 | 64 | | parking lots, and similar fa cilities. The authority may lease or 43 |
---|
65 | 65 | | sell such special purpose facilities to provide operators or 44 |
---|
66 | 66 | | concessionaires or such facilities may be operated by the 45 |
---|
67 | 67 | | authority in its discretion. 46 |
---|
68 | 68 | | (d) In the operation and management of the airports, the 47 |
---|
69 | 69 | | authority may employ such managers, supervisors, technicians, 48 |
---|
70 | 70 | | and other personnel as may be necessary for the economical and 49 |
---|
71 | 71 | | efficient management thereof, and shall have the power to adopt 50 |

82 | 82 | | rules and regulations with reference to all projects and matters 51 |

83 | 83 | | under its control. All rules and regulations of the authority 52 |

84 | 84 | | shall be a matter of public record, and copies thereof shall be 53 |

85 | 85 | | dispensed by the authority at cost to all applicants therefor. 54 |

86 | 86 | | (e) In acquiring property from the City of Sanford or from 55 |
---|
87 | 87 | | any public agency fo r airport purposes or in the operation of 56 |
---|
88 | 88 | | any airport, the authority shall have full power to contract 57 |
---|
89 | 89 | | with the Federal Aviation Authority or any federal agency 58 |
---|
90 | 90 | | exercising any function with respect to aviation, air 59 |
---|
91 | 91 | | navigation, or air transportation, and th e authority shall have 60 |
---|
92 | 92 | | full power to abide by all rules and regulations of such federal 61 |
---|
93 | 93 | | agencies including the uses to which land may be put and the 62 |
---|
94 | 94 | | operation of airports, air navigation facilities, and aircraft. 63 |
---|
95 | 95 | | The authority shall further have power to a ssume any 64 |
---|
96 | 96 | | obligations, covenants, or agreements heretofore imposed by any 65 |
---|
97 | 97 | | governmental agency by deed, deed restriction or contract on the 66 |
---|
98 | 98 | | City of Sanford, or any other governmental agency therein with 67 |
---|
99 | 99 | | respect to airports or aviation. 68 |
---|
100 | 100 | | (f) The authority i n the acquisition, financing and 69 |
---|
101 | 101 | | operation of airports and air navigation facilities may exercise 70 |
---|
102 | 102 | | the authority and powers provided for cities, counties, 71 |
---|
103 | 103 | | villages, or towns of Florida by chapter 332, Florida Statutes, 72 |
---|
104 | 104 | | known as the Airport Law of 1945. 73 |
---|
105 | 105 | | (g) The authority may advertise and publicize the use of 74 |
---|
106 | 106 | | any airport operated by it and may expend its funds for such 75 |
---|

119 | 119 | | refinance the acquisition or construction of airport projects by 78 |

120 | 120 | | issuing its revenue bonds or other debt obligations in the 79 |

121 | 121 | | manner provided by chapter 332, Florida Statutes, known as the 80 |
---|
122 | 122 | | Airport Law of 1945, or as provided by any other applicable 81 |
---|

124 | 124 | | (i) The authority may enter into exclusive or nonexclusive 83 |
---|
125 | 125 | | contracts, leases, franchises, or other arrangements with any 84 |
---|
126 | 126 | | person or persons for terms not exceeding 99 50 years, granting 85 |
---|
127 | 127 | | the privilege of using or improving any project of the 86 |
---|
128 | 128 | | authority, or any portion thereof of space therein, for 87 |
---|
129 | 129 | | commercial purposes; conferring the privilege of supplying 88 |
---|
130 | 130 | | goods, commodities, things, and services or facilities at such 89 |
---|
131 | 131 | | project or projects; making available services to be furnished 90 |
---|
132 | 132 | | by the authority or its agents at such project; and establishing 91 |
---|
133 | 133 | | the terms and conditions and fixing the charges, rentals, or 92 |
---|
134 | 134 | | fees for such privileges or services so long as such fees or 93 |
---|
135 | 135 | | charges shall not conflict with any applicable rules and 94 |
---|
136 | 136 | | regulations of the Public Service Commissi on. 95 |
---|
137 | 137 | | Section 2. This act shall take effect upon becoming a law. 96 |
