128128 Section 2. Section 1002.351, Florida Statutes, is created 79

130130 1002.351 The Florida School for Competitive Academics. — 81
131131 (1) ESTABLISHMENT.—There is established the Florida School 82
132132 for Competitive Academics. The school shall be located in 83
133133 Alachua County and is a state -supported public school for 84
134134 Florida residents in grades 6 -12. The primary purpose of the 85
135135 school is to provide a rigorous academic curriculum, and the 86
136136 secondary purpose is to prepare students for regional, state, 87
137137 and national academic competitions in all areas of study, 88
138138 including, but not limited to, science, technology, engineering, 89
139139 and mathematics. The school may admit students in grades 6 -12 90
140140 beginning in the 2024 -2025 school year. 91
141141 (2) MISSION.— 92
142142 (a) The mission of the Florida School for Competitive 93
143143 Academics is to provide students who meet selective admissions 94
144144 requirements an environment that will foster high academic 95
145145 engagement and advanced understanding of subject areas, develop 96
146146 productive work habits, build resiliency, connect students with 97
147147 industry leaders, and promote civic leadership. 98
148148 (b) To assist in the recruitment of students, the 99
149149 Commissioner of Education shall ensure all eligible students are 100

165165 School for Competitive Academics Board of Trustees for 104

167167 (3) BOARD OF TRUSTEES. — 106
168168 (a)1. The Florida School for Competitive Academics shall 107
169169 be governed by a board of trustees composed of seven members 108
170170 appointed by the Governor to 4 -year terms and confirmed by the 109
171171 Senate. For purposes of staggering terms, four me mbers, 110
172172 including the chair as designated by the Governor, shall be 111
173173 appointed to 4-year terms beginning July 1, 2023, and three 112
174174 members shall be appointed to 2 -year terms beginning July 1, 113
175175 2023. After the initial 4 -year term, the chair shall be elected 114
176176 by the board. 115
177177 2. No more than 116
178178 one employee of the school may serve on the board of trustees as 117
179179 a member or as chairman. 118
180180 (b) Members of the board of trustees shall serve without 119
181181 compensation, but may be reimbursed for per diem and travel 120

183183 (c) The board of trustees is a public agency entitled to 122
184184 sovereign immunity pursuant to s. 768.28, and board members are 123
185185 public officers who bear fiduciary responsibility for the 124

199199 (d) The board of trustees is a body corporate with all the 126
200200 powers of a body corporate, and such authority as is needed for 127
201201 the proper operation and improvement of the Florida School for 128
202202 Competitive Academics. Title to any gift, donation, or bequest 129
203203 received by the board o f trustees must vest in the board of 130
204204 trustees. Title to all other property and other assets of the 131
205205 Florida School for Competitive Academics must vest in the State 132
206206 Board of Education, but the board of trustees has complete 133
207207 jurisdiction over the management o f the school. 134
208208 (e) The board of trustees has the full power and authority 135

210210 1. Adopt rules pursuant to ss. 120.536(1) and 120.54 to 137
211211 implement provisions of law relating to operation of the Florida 138
212212 School for Competitive Academics. Such rules must be s ubmitted 139
213213 to the State Board of Education for approval or disapproval. 140
214214 After a rule is approved by the State Board of Education, the 141
215215 rule must be filed immediately with the Department of State. The 142
216216 board of trustees shall act at all times in conjunction wit h the 143
217217 rules of the State Board of Education. 144
218218 2. Appoint a principal, administrators, teachers, and 145
219219 other employees. 146
220220 3. Remove principals, administrators, teachers, and other 147

252252 (f) The board of trustees shall: 167
253253 1. Prepare and submit legislative budget requests for 168
254254 operations and fixed capital outlay, in accordance with chapter 169
255255 216 and ss. 1011.56 and 1013.60, to the Department of E ducation 170
256256 for review and approval. The department must analyze the amount 171
257257 requested for fixed capital outlay to determine if the request 172
258258 is consistent with the school's campus master plan, educational 173
259259 plant survey, and facilities master plan. 174

286286 6. Ensure that the Florida School for Competitive 189
287287 Academics complies with s. 112.061 concerning per diem and 190
288288 travel expenses. 191
289289 7. Adopt a master plan that specifies the objectives of 192
290290 the Florida School for Competitive Academics. The plan must be 193
291291 for a period of 5 years and must be reviewed for needed 194
292292 modifications every 2 years. The board of trustees shall submit 195
293293 the initial plan and subsequent modifications to the President 196
294294 of the Senate and the Speaker of the House of Representatives. 197
295295 (4) STUDENT AND EMPLOYEE RECORDS. —The board of trustees 198
296296 shall provide for the content and custody of student and 199
297297 employee personnel records. Student records are subject to s. 200

312312 (a) The Florida School for Competitive Academics Board of 203
313313 Trustees shall require a ll employees and applicants for 204
314314 employment to undergo background screening as provided in s. 205
315315 1012.32 as a condition of employment and continued employment. 206
316316 Members of the board of trustees must also undergo background 207
317317 screening in accordance with the relev ant provisions of s. 208
318318 1012.32. An individual may not be employed as an employee or 209
319319 contract personnel of the school or serve as a member of the 210
320320 board of trustees if the individual is on the disqualification 211
321321 list maintained by the department pursuant to s. 1 001.10(4)(b). 212
322322 (b) In accordance with law and rules of the State Board of 213
323323 Education, the board of trustees shall administer and maintain 214
324324 personnel programs for all employees of the board of trustees 215
325325 and the Florida School for Competitive Academics. The bo ard of 216
326326 trustees may adopt rules, policies, and procedures related to 217
327327 the appointment, employment, and removal of personnel. 218
328328 1. The board of trustees shall determine the compensation, 219
329329 including salaries and fringe benefits, and other conditions of 220
330330 employment for such personnel. 221
331331 2. Classroom teachers employed by the school must be 222
332332 certified pursuant to chapter 1012. 223
333333 3. Each person employed by the board of trustees in an 224

349349 4. All employees except temporary, seasonal, and student 228
350350 employees may be provided Florida Retirement System benefits 229

352352 (6) FUNDING.— 231
353353 (a) The Florida School for Competitive Academics shall 232
354354 receive state funds for operating purposes as provided in the 233
355355 General Appropriations Act. 234
356356 (b) In addition to the funds provided in the General 235
357357 Appropriations Act, the Florida School for Competitive Academics 236
358358 may receive other funds from grants and donations. 237
359359 (7) AUDITS.—The Auditor General shall conduct audits of 238
360360 the accounts and records of the Florida School for Competitive 239
361361 Academics as provided in s. 11.45. The Department o f Education's 240
362362 Inspector General is authorized to conduct investigations at the 241
363363 school as provided in s. 1001.20(4)(e). 242
364364 (8) EXEMPTION FROM STATUTES. — 243
365365 (a) The Florida School for Competitive Academics is exempt 244
366366 from all statutes in chapters 1000 -1013. However, the Florida 245
367367 School for Competitive Academics shall be in compliance with the 246
368368 following statutes in chapters 1000 -1013: 247

462462 (c) Subsequent to the Department of Ed ucation's approval, 305
463463 the Commissioner of Education shall include the Florida School 306
464464 for Competitive Academics in the department's legislative budget 307
465465 request to the State Board of Education, the Governor, and the 308
466466 Legislature. The legislative budget request a nd the 309
467467 appropriation for the Florida School for Competitive Academics 310
468468 must be a separate identifiable sum in the public schools budget 311
469469 entity of the Department of Education. 312
470470 (d) The annual appropriation for the school shall be 313
471471 distributed quarterly, with out using the Florida Education 314
472472 Finance Program, in payments as nearly equal as possible. 315
473473 Appropriations for textbooks, instructional technology, and 316
474474 school buses may be released and distributed as necessary to 317
475475 serve the instructional program for the stude nts. 318
476476 (2) The school shall submit its fixed capital outlay 319
477477 request to the Department of Education for review and approval 320
478478 in accordance with s. 1002.36(4)(f)1. Subsequent to the 321
479479 department's approval, the school's request must be included 322
480480 within the department's public education capital outlay 323
481481 legislative budget request. 324

498498 (1) Notwithstanding ss. 216.031, 216.181, and 216.262 to 329
499499 the contrary and pursuant s. 216.351, but subject to any 330
500500 guidelines imposed in the General Appropriations Act, funds for 331
501501 the operation of the Florida School for Competitive Academics 332
502502 shall be requested and appropriated within budget entities, 333
503503 program components, program categories, lump sums, or special 334
504504 categories. Funds appropriated to the Florida School for 335
505505 Competitive Academics for each program category, lump sum, or 336
506506 special category may be transferred to traditional categories 337
507507 for expenditure by the board of trustees of the school. The 338
508508 board of trustees shall develop an annual operating budget that 339
509509 allocates funds by program component and traditional expenditure 340
510510 category. 341
511511 (2) Notwithstanding s. 216.181 and pursuant to s. 216.351, 342
512512 but subject to any requirements imposed in the General 343
513513 Appropriations Act, a lump -sum plan is not required to implement 344
514514 the special categories, program categories, or lump -sum 345
515515 appropriations. Upon release of the special categories, program 346
516516 categories, or lump-sum appropriations to the board of trustees, 347
517517 the Chief Financial Officer shall, upon the request of the board 348
518518 of trustees, transfer or reallocate funds to or among accounts 349

534534 (3) Notwithstanding ss. 216.031, 216.181, 216.251, and 353
535535 216.262 to the contrary and pursuant to s. 216.351, but subject 354

537537 the board of trustees shall establish the authorized positions 356
538538 and may amend such positions within the total funds authorized 357

540540 (4)(a) Notwithstanding s. 216.301 to the contrary, all 359
541541 unexpended funds appropriated for the Florida School for 360
542542 Competitive Academics shall be carried forward and included as 361
543543 the balance forward for that fund in the approved operating 362

545545 (b) Notwithstanding any other law, for the 2023 -2024 364
546546 through 2027-2028 fiscal years, the school's board of trustees 365
547547 may expend, reserve, or carry forward balances from prior year 366
548548 operational and programmatic appropriations for fixed capital 367
549549 outlay projects needed for the establishment of this school. 368
