A bill to be entitled 1 
An act relating to the Opioid Settlement Trust Fund; 2 
creating s. 20.507, F.S.; creating the Opioid 3 
Settlement Trust Fund within the Department of 4 
Children and Families; providing the purpose of such 5 
trust fund; providing for the future review and 6 
termination of such trust fund; amending s. 20.195, 7 
F.S.; providing for the administration of the Opioid 8 
Settlement Trust Fund by the department; providing the 9 
source of funds; providing an exemption from a certain 10 
service charge; requiring funds to revert under 11 
certain conditions; providing an effective date. 12

Be It Enacted by the Legislature of the State of Florida: 14 
 15 
 Section 1.  Section 20.507, Florida Statutes, is created to 16 
read: 17 
 20.507  Opioid Settlement Trust Fund. — 18 
 (1)  The Opioid Settlement Trust Fund is created within the 19 
Department of Children and Families for the purpose of funding 20 
programs and services that prevent and treat substance use 21 
disorders and mental health conditions, support addiction 22 
recovery, and implement opioid abatement strategies. 23 
 (2)  In accordance with s. 19(f)(2), Art. III of the State 24 
Constitution, the Opioid Settlement Trust Fund shall, unless 25

terminated sooner, be terminated on July 1, 2027. Before its 26 
scheduled termination, the fund shall be reviewed as provided in 27 
s. 215.3206(1) and (2). 28 
 Section 2.  Subsection (11) is added to section 20.195, 29 
Florida Statutes, to read: 30 
 20.195  Department of Children and Families; trust fund s.—31 
The following trust funds shall be administered by the 32 
Department of Children and Families: 33 
 (11)  Opioid Settlement Trust Fund. 34 
 (a)  Funds to be credited in the trust fund shall consist 35 
of funds disbursed, by nonoperating transfer, from the 36 
Department of Financial Services Opioid Settlement Clearing 37 
Trust Fund in amounts equal to the appropriations made from this 38 
trust fund. Funds deposited into the trust fund are exempt from 39 
the service charges imposed under s. 215.20. 40 
 (b)  Notwithstanding the provis ions of s. 216.301 and 41 
pursuant to s. 216.351, any unencumbered balance remaining 42 
undisbursed on September 30 of the same calendar year shall 43 
revert to the Department of Financial Services Opioid Settlement 44 
Clearing Trust Fund. 45 
 Section 3.  This act shal l take effect July 1, 2023. 46
