ENROLLED HB 7027 2023 Legislature CODING: Words stricken are deletions; words underlined are additions. hb7027-01-er Page 1 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 1 An act relating to ratification of rules of the 2 Department of Environmental Protection; ratifying 3 specified rules relating to standards for onsite 4 sewage treatment and disposal systems and for domestic 5 wastewater facility planning for facilities expansion, 6 collection/transmission systems, and an operation and 7 maintenance manual for the sole and exclusive purpose 8 of satisfying any condition on effecti veness pursuant 9 to s. 120.541(3), F.S., which requires ratification of 10 any rule exceeding the specified thresholds for likely 11 adverse impact or increase in regulatory costs; 12 providing construction ; providing an effective date. 13 14 Be It Enacted by the Leg islature of the State of Florida: 15 16 Section 1. (1) The following rules are ratified for the 17 sole and exclusive purpose of satisfying any condition on the 18 effectiveness imposed under s. 120.541(3), Florida Statutes: 19 (a) Rule 62-6.001, Florida Administ rative Code, titled 20 "General," as filed for adoption with the Department of State 21 pursuant to the certification package dated May 10, 2022. 22 (b) Rules 62-600.405, 62-600.705, and 62-600.720, Florida 23 Administrative Code, titled "Domestic Wastewater Facilit ies: 24 Planning for Wastewater Facilities Expansion," "Domestic 25 ENROLLED HB 7027 2023 Legislature CODING: Words stricken are deletions; words underlined are additions. hb7027-01-er Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Wastewater Facilities: Collection/Transmission Systems," and 26 "Domestic Wastewater Facilities: Operation and Maintenance 27 Manual," respectively, as filed for adoption with the Department 28 of State pursuant to the certification package dated November 29 16, 2021. 30 (2) This act serves no other purpose and may not be 31 codified in the Florida Statutes. After this act becomes a law, 32 its enactment and effective dates must be noted in the Florida 33 Administrative Code, the Florida Administrative Register, or 34 both, as appropriate. This act does not alter rulemaking 35 authority delegated by prior law, does not constitute 36 legislative preemption of or exception to any provision of law 37 governing adoption or enforcement of the rule cited, and is 38 intended to preserve the status of any cited rule as a rule 39 under chapter 120, Florida Statutes. This act does not cure any 40 rulemaking defect or preempt any challenge based on a lack of 41 authority or a violation of the legal requi rements governing the 42 adoption of any rule cited. 43 Section 2. This act shall take effect upon becoming a law. 44
