Florida Senate - 2023 CS for SB 424 By the Committee on Criminal Justice; and Senator Davis 591-03486-23 2023424c1 1 A bill to be entitled 2 An act relating to time limitations for prosecution of 3 certain sexual battery offenses; amending s. 775.15, 4 F.S.; revising the time limitations for prosecution of 5 specified sexual battery offenses committed on victims 6 18 years of age or older in certain circumstances; 7 providing applicability; providing an effective date. 8 9 Be It Enacted by the Legislature of the State of Florida: 10 11 Section 1.Subsection (14) of section 775.15, Florida 12 Statutes, is amended to read: 13 775.15Time limitations; general time limitations; 14 exceptions. 15 (14)(a)A prosecution for a first or second degree felony 16 violation of s. 794.011, if the victim is 16 years of age or 17 older at the time of the offense and the offense is reported to 18 a law enforcement agency within 72 hours after commission of the 19 offense, may be commenced at any time. 20 (b)A prosecution for a first or second degree felony 21 violation of s. 794.011, if the victim is 18 years of age or 22 older at the time of the offense and the offense is reported to 23 a law enforcement agency or a person acting within the scope of 24 his or her practice who is licensed under chapter 458, chapter 25 459, chapter 490, or chapter 491 within 21 days after commission 26 of the offense, may be commenced at any time. This paragraph 27 applies to an offense that is committed on or after July 1, 28 2023. 29 (c)(b)Except as provided in paragraph (a), or paragraph 30 (13)(b), or subsection (20), a prosecution for a first or second 31 degree felony violation of s. 794.011, if the victim is 16 years 32 of age or older at the time of the offense, must be commenced 33 within 8 years after the violation is committed. This paragraph 34 applies to any such offense except an offense the prosecution of 35 which would have been barred by subsection (2) on or before July 36 1, 2015. 37 Section 2.This act shall take effect July 1, 2023.
