Subsection (4) of section 1013.40, Florida 13 Statutes, is amended to read: 14 1013.40 Planning and construction of Florida College 15 System institution facilities; property acquisition. — 16 (4) The campus of a Florida College Syste m institution 17 within a municipality designated as an area of critical state 18 concern, as defined in s. 380.05, and having a comprehensive 19 plan and land development regulations containing a building 20 permit allocation system that limits annual growth, may 21 construct dormitories for up to 340 beds for Florida College 22 System institution students, and an additional 50 25 beds for 23 employees, educators, health care workers, and first responders. 24 Such dormitories are exempt from the building permit allocation 25 CS/HB 217 2024 CODING: Words stricken are deletions; words underlined are additions. hb0217-01-c1 Page 2 of 2 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S system and may be constructed up to 60 feet in height if the 26 dormitories are otherwise consistent with the comprehensive 27 plan, the Florida College System institution has a hurricane 28 evacuation plan that requires all dormitory occupants to be 29 evacuated 48 hours in advance of tropical force winds, and 30 transportation is provided for dormitory occupants during an 31 evacuation. State grant funds and, notwithstanding s. 32 1009.23(11)(b), capital improvement tuition and fee revenues may 33 not be used for construction, debt ser vice payments, 34 maintenance, or operation of such dormitories. Additional 35 dormitory beds constructed after July 1, 2016, may not be 36 financed through the issuance of bonds by the Florida College 37 System institution; however, bonds may be issued by nonpublic 38 entities as part of a public -private partnership between the 39 college and a nonpublic entity. 40 Section 2. This act shall take effect July 1, 2024. 41
