242242 made by this act to section 775.21, Florida Statutes, in a 157
243243 reference thereto, paragraph (b) of subsection (6) of section 158

245245 39.509 Grandparents rights. —Notwithstanding any other 160
246246 provision of law, a maternal or paternal grandparent as well as 161
247247 a stepgrandparent is entitled to reasona ble visitation with his 162
248248 or her grandchild who has been adjudicated a dependent child and 163
249249 taken from the physical custody of the parent unless the court 164
250250 finds that such visitation is not in the best interest of the 165
251251 child or that such visitation would interf ere with the goals of 166
252252 the case plan. Reasonable visitation may be unsupervised and, 167
253253 where appropriate and feasible, may be frequent and continuing. 168
254254 Any order for visitation or other contact must conform to the 169
255255 provisions of s. 39.0139. 170
256256 (6) In determining whether grandparental visitation is not 171
257257 in the child's best interest, consideration may be given to the 172

274274 Section 6. For the purpose of incorporating the amendment 177
275275 made by this act to section 775.21, Florida Statutes, in a 178
276276 reference thereto, paragraphs (d) and (n) of subsection (1) of 179
277277 section 39.806, Florida Statutes, are reenacted to read: 180
278278 39.806 Grounds for termination of parental rights. — 181
279279 (1) Grounds for the termination of parental rights may be 182
280280 established under any of the following circumstances: 183
281281 (d) When the parent of a child is incarcerated and either: 184
282282 1. The period of time for which the parent is expected to 185
283283 be incarcerated will constitute a significant portion of the 186
284284 child's minority. When determining whether the period of time is 187
285285 significant, the court shall consider the child's age and the 188
286286 child's need for a permanent and sta ble home. The period of time 189
287287 begins on the date that the parent enters into incarceration; 190
288288 2. The incarcerated parent has been determined by the 191
289289 court to be a violent career criminal as defined in s. 775.084, 192
290290 a habitual violent felony offender as defined in s. 775.084, or 193
291291 a sexual predator as defined in s. 775.21; has been convicted of 194
292292 first degree or second degree murder in violation of s. 782.04 195
293293 or a sexual battery that constitutes a capital, life, or first 196
294294 degree felony violation of s. 794.011; or has been convicted of 197
295295 an offense in another jurisdiction which is substantially 198
296296 similar to one of the offenses listed in this paragraph. As used 199
297297 in this section, the term "substantially similar offense" means 200

311311 penalties to one of those listed in this subparagraph, and that 202
312312 is in violation of a law of any other jurisdiction, whether that 203
313313 of another state, the District of Columbia, the United States or 204
314314 any possession or territory thereof, or any foreign 205
315315 jurisdiction; or 206
316316 3. The court determines by clear and convincing evidence 207
317317 that continuing the parental relationship with the incarcerated 208
318318 parent would be harmful to the child and, for this reason, that 209
319319 termination of the parental rights of the incarcerated parent is 210
320320 in the best interest of the child. When determining harm, the 211
321321 court shall consider the following factors: 212
322322 a. The age of the child. 213
323323 b. The relationship between the child and the parent. 214
324324 c. The nature of the parent's current and past provisio n 215
325325 for the child's developmental, cognitive, psychological, and 216
326326 physical needs. 217
327327 d. The parent's history of criminal behavior, which may 218
328328 include the frequency of incarceration and the unavailability of 219
329329 the parent to the child due to incarceration. 220
330330 e. Any other factor the court deems relevant. 221
331331 (n) The parent is convicted of an offense that requires 222
332332 the parent to register as a sexual predator under s. 775.21. 223
333333 Section 7. For the purpose of incorporating the amendment 224

366366 definition contained in s. 63.032. A finding of abandonment may 245
367367 also be based upon emotional abuse or a refusal to provide 246
368368 reasonable financial support, when able, to a birth mother 247
369369 during her pregnancy or on whether the person alleged to have 248
370370 abandoned the child, while being able, failed to establish 249

385385 (b) The child has been abandoned when the parent of a 252
386386 child is incarcerated on or after October 1, 2001, in a federal, 253
387387 state, or county correctional institution and: 254
388388 1. The period of time for which the parent has been or is 255
389389 expected to be incarcerated will constitute a significant 256
390390 portion of the child's minority. In determining whether the 257
391391 period of time is significant, the court shall consider the 258
392392 child's age and the child's need for a permanent and stable 259
393393 home. The period of time begins on the date that the parent 260
394394 enters into incarceration; 261
395395 2. The incarcerated parent has been determined by a court 262
396396 of competent jurisdiction to be a v iolent career criminal as 263
397397 defined in s. 775.084, a habitual violent felony offender as 264
398398 defined in s. 775.084, convicted of child abuse as defined in s. 265
399399 827.03, or a sexual predator as defined in s. 775.21; has been 266
400400 convicted of first degree or second degre e murder in violation 267

404404 jurisdiction. As used in this section, the term "su bstantially 271
405405 similar offense" means any offense that is substantially similar 272
406406 in elements and penalties to one of those listed in this 273
407407 subparagraph, and that is in violation of a law of any other 274

428428 Section 9. For the purpose of incorporating the amendment 283
429429 made by this act to section 775.21, Florida Statutes, in a 284
430430 reference thereto, subsection (3) of section 63.092, Florida 285
431431 Statutes, is reenacted to read: 286
432432 63.092 Report to the court of intended placement by an 287
433433 adoption entity; at-risk placement; preliminary study. — 288
434434 (3) PRELIMINARY HOME STUDY. —Before placing the minor in 289
435435 the intended adoptive home, a preliminary home study must be 290
436436 performed by a licensed child -placing agency, a child -caring 291
437437 agency registered under s. 409.176, a licensed professional, or 292
438438 an agency described in s. 61.20(2), unless the adoptee is an 293
439439 adult or the petitioner is a stepparent or a relative. If the 294
440440 adoptee is an adult or the petitioner is a stepparent or a 295
441441 relative, a preliminary home study may be required by the court 296
442442 for good cause shown. The department is required to perform the 297
443443 preliminary home study only if there is no licensed child -298
444444 placing agency, child -caring agency registered under s. 409.176, 299
445445 licensed professional, or agency described in s. 61.20(2), in 300

458458 the county where the prospective adoptive parents reside. The 301
459459 preliminary home study mu st be made to determine the suitability 302
460460 of the intended adoptive parents and may be completed before 303
461461 identification of a prospective adoptive minor. If the 304
462462 identified prospective adoptive minor is in the custody of the 305
463463 department, a preliminary home study must be completed within 30 306
464464 days after it is initiated. A favorable preliminary home study 307
465465 is valid for 1 year after the date of its completion. Upon its 308
466466 completion, a signed copy of the home study must be provided to 309
467467 the intended adoptive parents who were the subject of the home 310
468468 study. A minor may not be placed in an intended adoptive home 311
469469 before a favorable preliminary home study is completed unless 312
470470 the adoptive home is also a licensed foster home under s. 313
471471 409.175. The preliminary home study must include, at a minimum: 314
472472 (a) An interview with the intended adoptive parents. 315
473473 (b) Records checks of the department's central abuse 316
474474 registry, which the department shall provide to the entity 317
475475 conducting the preliminary home study, and criminal records 318
476476 correspondence checks under s. 39.0138 through the Department of 319
477477 Law Enforcement on the intended adoptive parents. 320
478478 (c) An assessment of the physical environment of the home. 321
479479 (d) A determination of the financial security of the 322
480480 intended adoptive parents. 323
481481 (e) Documentation of counseling and education of the 324
482482 intended adoptive parents on adoptive parenting, as determined 325

588588 records or to the office of the Federal Bureau of Investigation. 395
