A bill to be entitled 1 
An act relating to continuing chiropractic education; 2 
amending s. 460.408, F.S.; deleting a requirement that 3 
chiropractic continuing education be completed in a 4 
classroom setting; prohibiting the Board of 5 
Chiropractic Medicine from limiting the number of 6 
approved continuing education hours that may be 7 
completed through distance learning; authorizing the 8 
board to provide exceptions to continuing education 9 
requirements during a declared state of emergency; 10 
providing requirements for continuing education 11 
instructors; requiring the board to adopt rules; 12 
providing an effective date. 13

Be It Enacted by the Legislature of the State of Florida: 15 
 16 
 Section 1.  Section 4 60.408, Florida Statutes, is amended 17 
to read: 18 
 460.408  Continuing chiropractic education. — 19 
 (1)  The board shall require licensees to periodically 20 
demonstrate their professional competence as a condition of 21 
renewal of a license by completing up to 40 contact classroom 22 
hours of continuing education. 23 
 (a)  Continuing education courses sponsored by chiropractic 24 
colleges whose graduates are eligible for examination under any 25

provision of this chapter may be approved upon review by the 26 
board if all other requir ements of board rules setting forth 27 
criteria for course approval are met. 28 
 (b)  The board shall approve those courses that build upon 29 
the basic courses required for the practice of chiropractic 30 
medicine, and the board may also approve courses in adjunctive 31 
modalities. Courses that consist of instruction in the use, 32 
application, prescription, recommendation, or administration of 33 
a specific company's brand of products or services are not 34 
eligible for approval. 35 
 (c)  The board may not limit the number of appro ved 36 
continuing education hours that may be completed through 37 
distance learning. 38 
 (2)  The board may provide exceptions to make exception 39 
from the requirements of this section in emergency or hardship 40 
cases and during a declared state of emergency . 41 
 (3)  Continuing education courses shall be taught by an 42 
instructor with at least one of the following qualifications: 43 
 (a)  Holds a postgraduate degree, or bachelor's degree with 44 
at least 2 years' experience in the subject matter taught. 45 
 (b)  Is a current facult y member of a chiropractic college 46 
or school maintaining a standard and reputability approved by 47 
the board or is a current faculty member at a medical or an 48 
osteopathic college or a university accredited by, or having 49 
status with, an accrediting body recog nized by the Council for 50

Higher Education Accreditation or its successor or the United 51 
States Department of Education. 52 
 (c)  Is a postgraduate -level instructor at a chiropractic 53 
college or school maintaining a standard and reputability 54 
approved by the boar d, or a postgraduate -level instructor at a 55 
medical or an osteopathic college or a university accredited by, 56 
or having status with, an accrediting body recognized by the 57 
Office of Postsecondary Education or its successor or the United 58 
States Department of E ducation. 59 
 (4)(3) The board shall may adopt rules to implement within 60 
the requirements of this section that are necessary for its 61 
implementation. 62 
 Section 2.  This act shall take effect July 1, 2024. 63
