2525 Be It Enacted by the Legislature of the State of Florida: 12

2727 Section 1. Subsections (3) and (4) are added to section 14
2828 903.047, Florida Statutes, to read: 15
2929 903.047 Conditions of pretrial release. — 16
3030 (3)(a) If a secure continuous remote alcohol monitor is 17
3131 required as a condition of release, the defendant's release may 18
3232 not be delayed more than 2 hours after the oral pronouncement of 19
3333 the order if the defendant is to be released on his or her own 20
3434 recognizance or, if there i s a monetary component to the 21
3535 release, more than 2 hours after the defendant's bail or bond is 22
3636 posted. 23
3737 (b) A requirement of a secure continuous remote alcohol 24
3838 monitor vendor to have a cosignor for the monitoring device or 25

5151 payment from a person other than the defendant may not delay the 26
5252 defendant's release. Such a vendor requirement must be 27
5353 established no later than 24 hours after the defendant's 28
5454 release. 29
5555 (c) A secure continuous remote alcohol monitor may not be 30
5656 required for a first misdemeanor offense u nless it is shown by 31
5757 clear and convincing evidence that such a monitor is required to 32
5858 protect the public safety. 33
5959 (4) Notwithstanding any other law, a defendant may not be 34
6060 required to surrender a license to carry a concealed weapon or 35
6161 concealed firearm in conjunction with a first misdemeanor 36
6262 offense unless it appears that the defendant would present a 37
6363 danger to the public if he or she were to possess the concealed 38
6464 weapon or concealed firearm. 39
6565 Section 2. This act shall take effect July 1, 2024. 40
