A bill to be entitled 1 
An act relating to conditions of pretrial release; 2 
amending s. 903.047, F.S.; providing requirements 3 
concerning release of a defendant when a secure 4 
continuous remote alcohol monitor is required as a 5 
condition of release; prohibiting a defendant from 6 
being required to surrender a license to carry a 7 
concealed weapon or concealed firearm in conjunction 8 
with a first misdemeanor offense except in certain 9 
circumstances; providing an effective date. 10 
 11 
Be It Enacted by the Legislature of the State of Florida: 12 
 13 
 Section 1.  Subsections (3) and (4) are added to section 14 
903.047, Florida Statutes, to read: 15 
 903.047  Conditions of pretrial release. — 16 
 (3)(a)  If a secure continuous remote alcohol monitor is 17 
required as a condition of release, the defendant's release may 18 
not be delayed more than 2 hours after the oral pronouncement of 19 
the order if the defendant is to be released on his or her own 20 
recognizance or, if there i s a monetary component to the 21 
release, more than 2 hours after the defendant's bail or bond is 22 
posted. 23 
 (b)  A requirement of a secure continuous remote alcohol 24 
monitor vendor to have a cosignor for the monitoring device or 25

payment from a person other than the defendant may not delay the 26 
defendant's release. Such a vendor requirement must be 27 
established no later than 24 hours after the defendant's 28 
release. 29 
 (c)  A secure continuous remote alcohol monitor may not be 30 
required for a first misdemeanor offense u nless it is shown by 31 
clear and convincing evidence that such a monitor is required to 32 
protect the public safety. 33 
 (4)  Notwithstanding any other law, a defendant may not be 34 
required to surrender a license to carry a concealed weapon or 35 
concealed firearm in conjunction with a first misdemeanor 36 
offense unless it appears that the defendant would present a 37 
danger to the public if he or she were to possess the concealed 38 
weapon or concealed firearm. 39 
 Section 2.  This act shall take effect July 1, 2024. 40
