19	19	applicability; reenacting ss. 604.40(2) and 6
20	20	604.50(2)(e), F.S., relating to farm equipment used in 7
21	21	urban agriculture and nonresidential farm buildings, 8
22	22	farm fences, and farm signs, respectively, to 9
23	23	incorporate the amendment made to s. 604.73, F.S., in 10
24	24	references thereto; providing an effective date. 11

26	26	Be It Enacted by the Legislature of the State of Florida: 13

28	28	Section 1. Paragraph (b) of subsection (3) of section 15
29	29	604.73, Florida Statutes, is amended, and subs ection (6) is 16
30	30	added to that section, to read: 17
31	31	604.73 Urban agriculture pilot projects; local regulation 18
32	32	of urban agriculture. — 19
33	33	(3) DEFINITIONS.—As used in this section, the term: 20
34	34	(b) "Urban agriculture" means any new or existing 21
35	35	noncommercial or new commercial agricultural uses on land that 22
36	36	is: 23
37	37	1. Within a dense urban land area, as described in s. 24
38	38	380.0651(3)(a); 25

51	51	2. Not classified as agricultural pursuant to s. 193.461; 26
52	52	3. Not zoned as agricultural as its principal use; and 27
53	53	4. Designated by a municipality for inclusion in an urban 28
54	54	agricultural pilot project that has been approved by the 29
55	55	department. 30

57	57	The term does not include vegetable gardens, as defined in s. 32
58	58	604.71(4), for personal consumption on residential properties. 33
59	59	(6) APPLICABILITY.-This section does not apply to an urban 34
60	60	agriculture project that is not a pilot project under this 35
61	61	section. 36
62	62	Section 2. For the purpose of incorporating the amendment 37
63	63	made by this act to section 604.73, Florida Statutes, in a 38
64	64	reference thereto, subsectio n (2) of section 604.40, Florida 39
65	65	Statutes, is reenacted to read: 40
66	66	604.40 Farm equipment. — 41
67	67	(2) This section does not apply to farm equipment that is 42
68	68	used in urban agriculture, as defined in s. 604.73(3). 43
69	69	Section 3. For the purpose of incorporating the amendment 44
70	70	made by this act to section 604.73, Florida Statutes, in a 45
71	71	reference thereto, paragraph (e) of subsection (2) of section 46
72	72	604.50, Florida Statutes, is reenacted to read: 47
73	73	604.50 Nonresidential farm buildings; farm fences; farm 48
