An act relating to urban agriculture pilot projects; 2
amending s. 604.73, F.S.; redefining the term "urban 3
agriculture" to include both commercial and 4
noncommercial agricultural uses; providing 5
applicability; reenacting ss. 604.40(2) and 6
604.50(2)(e), F.S., relating to farm equipment used in 7
urban agriculture and nonresidential farm buildings, 8
farm fences, and farm signs, respectively, to 9
incorporate the amendment made to s. 604.73, F.S., in 10
references thereto; providing an effective date. 11

Be It Enacted by the Legislature of the State of Florida: 13

Section 1. Paragraph (b) of subsection (3) of section 15
604.73, Florida Statutes, is amended, and subs ection (6) is 16
added to that section, to read: 17
604.73 Urban agriculture pilot projects; local regulation 18
of urban agriculture. — 19
(3) DEFINITIONS.—As used in this section, the term: 20
(b) "Urban agriculture" means any new or existing 21
noncommercial or new commercial agricultural uses on land that 22
is: 23
1. Within a dense urban land area, as described in s. 24
380.0651(3)(a); 25

2. Not classified as agricultural pursuant to s. 193.461; 26
3. Not zoned as agricultural as its principal use; and 27
4. Designated by a municipality for inclusion in an urban 28
agricultural pilot project that has been approved by the 29
department. 30

The term does not include vegetable gardens, as defined in s. 32
604.71(4), for personal consumption on residential properties. 33
(6) APPLICABILITY.-This section does not apply to an urban 34
agriculture project that is not a pilot project under this 35
section. 36
Section 2. For the purpose of incorporating the amendment 37
made by this act to section 604.73, Florida Statutes, in a 38
reference thereto, subsectio n (2) of section 604.40, Florida 39
Statutes, is reenacted to read: 40
604.40 Farm equipment. — 41
(2) This section does not apply to farm equipment that is 42
used in urban agriculture, as defined in s. 604.73(3). 43
Section 3. For the purpose of incorporating the amendment 44
made by this act to section 604.73, Florida Statutes, in a 45
reference thereto, paragraph (e) of subsection (2) of section 46
604.50, Florida Statutes, is reenacted to read: 47
604.50 Nonresidential farm buildings; farm fences; farm 48
signs.— 49
(2) As used in this section, the term: 50

(e) "Urban agriculture" has the same meaning as in s. 51
604.73(3). 52
Section 4. This act shall take effect July 1, 2024. 53
