1515 An act relating to temporary cash assistance 2

18-Department of Children and Families determines that 5
19-such person is a victim of human trafficking; 6

22-Be It Enacted by the Legislature of the State of Florida: 9

24- Section 1. Subsection (1) of section 414.095, Florida 11
25-Statutes, is amended to read: 12
26- 414.095 Determining eligibility for temporary cash 13
27-assistance.β€” 14
28- (1) ELIGIBILITY.β€”An applicant must meet the eligibility 15
29-requirements of this section before receiving services or 16
30-temporary cash assistance under this chapter, except that an 17
31-applicant is shall be required to register for work and engage 18
32-in work activities in accordance with s. 445.024, as designated 19
33-by the local workforce development board, and may receive 20
34-support services or child care assistance in conjunction with 21
35-such requirement. The department shall make a determination of 22
36-eligibility based on the criteria listed in this chapter. The 23
37-department shall monitor continued eligibility for temporary 24
38-cash assistance through periodic reviews consistent with the 25
16+eligibility; amending s. 414.095, F.S.; removing the 3
17+prohibition of awarding benefits to a person who has a 4
18+felony drug conviction for trafficking; removing 5
19+specified requirements in order for a person convicted 6
20+of a drug felony to receive benefits; providing an 7
21+effective date. 8

51-food assistance eligibility process. Benefits may not be denied 26
52-to an individual solely based on a felony drug conviction, 27
53-unless the conviction is for trafficking pursuant to s. 893.135. 28
54-Benefits may not be denied to an individual solely on the basis 29
55-of a trafficking convi ction pursuant to s. 893.135 if the 30
56-department has determined that such individual is a victim of 31
57-human trafficking, as defined in s. 943.0583(1). To be eligible 32
58-under this section, an individual convicted of a drug felony 33
59-must be satisfactorily meeting th e requirements of the temporary 34
60-cash assistance program, including all substance abuse treatment 35
61-requirements. Within the limits specified in this chapter, the 36
62-state opts out of the provision of Pub. L. No. 104 -193, s. 115, 37
63-that eliminates eligibility for temporary cash assistance and 38
64-food assistance for any individual convicted of a controlled 39
65-substance felony. 40
66- Section 2. This act shall take effect July 1, 2024. 41
