2424 Be It Enacted by the Legislature of the State of Florida: 11

2626 Section 1. Section 386.2095, Florida Statutes, is created 13
2727 to read: 14
2828 386.2095 Smoking and vaping prohibited in state parks. — 15
2929 (1) A person may not smoke or vape within the boundaries 16
3030 of a state park. 17
3131 (2) The department shall conspicuously post at each 18
3232 entrance of each state park signs stating that smoking and 19
3333 vaping are prohibited within the boundaries of the state park. 20
3434 The signs must be clearly legible in a font size of at least 1 21
3535 inch in height and incl ude the words "SMOKING OR VAPING WITHIN 22
3636 STATE PARK BOUNDARIES IS PROHIBITED BY LAW." 23
3737 (3) A person who violates subsection (1) is subject to 24
3838 penalties as provided in s. 386.208. 25

5151 Section 2. Section 386.208, Florida Statutes, is amended 26

5353 386.208 Penalties.—Any person who violates s. 386.204 or 28
5454 s. 386.2095 commits a noncriminal violation as defined in s. 29
5555 775.08(3), punishable by a fine of not more than $100 for the 30
5656 first violation and not more than $500 for each subsequent 31
5757 violation. Jurisdictio n shall be with the appropriate county 32
5858 court. 33
5959 Section 3. This act shall take effect July 1, 2024. 34
