A bill to be entitled 1 
An act relating to prohibition of smoking and vaping 2 
in state parks; creating s. 386.2095, F.S.; 3 
prohibiting smoking and vaping within the boundaries 4 
of state parks; requiring the Department of Health to 5 
post signs at specified locations; providing sign 6 
requirements; providing penalties; amending s. 7 
386.208, F.S.; conforming a provision to changes made 8 
by the act; providing an effective date. 9

Be It Enacted by the Legislature of the State of Florida: 11 
 12 
 Section 1.  Section 386.2095, Florida Statutes, is created 13 
to read: 14 
 386.2095  Smoking and vaping prohibited in state parks. — 15 
 (1)  A person may not smoke or vape within the boundaries 16 
of a state park. 17 
 (2)  The department shall conspicuously post at each 18 
entrance of each state park signs stating that smoking and 19 
vaping are prohibited within the boundaries of the state park. 20 
The signs must be clearly legible in a font size of at least 1 21 
inch in height and incl ude the words "SMOKING OR VAPING WITHIN 22 
STATE PARK BOUNDARIES IS PROHIBITED BY LAW." 23 
 (3)  A person who violates subsection (1) is subject to 24 
penalties as provided in s. 386.208. 25

 Section 2.  Section 386.208, Florida Statutes, is amended 26 
to read: 27 
 386.208  Penalties.—Any person who violates s. 386.204 or 28 
s. 386.2095 commits a noncriminal violation as defined in s. 29 
775.08(3), punishable by a fine of not more than $100 for the 30 
first violation and not more than $500 for each subsequent 31 
violation. Jurisdictio n shall be with the appropriate county 32 
court. 33 
 Section 3.  This act shall take effect July 1, 2024. 34
