2828 Be It Enacted by the Legislature of the State of Florida: 15

3030 Section 1. Section 409.9141, Florida Statutes, is created 17

3232 409.9141 Medicaid buy -in program for individuals with 19
3333 disabilities.— 20
3434 (1)(a) The agency shall establish and, subject to federal 21
3535 approval through a waiver or state plan amendment, implement a 22
3636 Medicaid buy-in program, authorized under the Ticket to Work and 23
3737 Work Incentives Improvement Act of 1999, Pub. L. No. 106 -170, 24
3838 and the Balanced Budget Act of 1997, Pub. L. No. 105 -33, for 25

5151 individuals with disabilities who are between 18 and 64 years of 26
5252 age and whose incomes exce ed the maximum income eligibility 27
5353 level for initial enrollment to obtain coverage for medical 28
5454 assistance under the Medicaid program. 29
5555 (b) The Medicaid buy -in program must provide full Medicaid 30
5656 benefits to eligible individuals and must limit any premiums o r 31
5757 cost sharing to a certain percentage of an individual's income, 32
5858 as determined by the agency. 33
5959 (2) By October 1, 2024, the agency shall seek federal 34
6060 waiver approval or submit any state plan amendments necessary to 35
6161 implement the Medicaid buy -in program under this section. The 36
6262 agency shall implement the program upon receiving federal 37
6363 approval. 38
6464 Section 2. This act shall take effect upon becoming a law. 39
