A bill to be entitled 1 
An act relating to Medicaid expansion through a 2 
Medicaid buy-in program; creating s. 409.9141, F.S.; 3 
requiring the Agency for Health Care Administration to 4 
establish and implement a Medicaid buy -in program for 5 
specified individuals with disabilities under certain 6 
circumstances; providing requirements for the program; 7 
requiring the agency to seek by a specified date 8 
federal waiver approval or submit any state plan 9 
amendments necessary to implement the program; 10 
requiring the agency to implement the program upon 11 
receiving federal approval; providing an effective 12 
date. 13

Be It Enacted by the Legislature of the State of Florida: 15 
 16 
 Section 1.  Section 409.9141, Florida Statutes, is created 17 
to read: 18 
 409.9141  Medicaid buy -in program for individuals with 19 
disabilities.— 20 
 (1)(a)  The agency shall establish and, subject to federal 21 
approval through a waiver or state plan amendment, implement a 22 
Medicaid buy-in program, authorized under the Ticket to Work and 23 
Work Incentives Improvement Act of 1999, Pub. L. No. 106 -170, 24 
and the Balanced Budget Act of 1997, Pub. L. No. 105 -33, for 25

individuals with disabilities who are between 18 and 64 years of 26 
age and whose incomes exce ed the maximum income eligibility 27 
level for initial enrollment to obtain coverage for medical 28 
assistance under the Medicaid program. 29 
 (b)  The Medicaid buy -in program must provide full Medicaid 30 
benefits to eligible individuals and must limit any premiums o r 31 
cost sharing to a certain percentage of an individual's income, 32 
as determined by the agency. 33 
 (2)  By October 1, 2024, the agency shall seek federal 34 
waiver approval or submit any state plan amendments necessary to 35 
implement the Medicaid buy -in program under this section. The 36 
agency shall implement the program upon receiving federal 37 
approval. 38 
 Section 2.  This act shall take effect upon becoming a law. 39
