27 | 27 | | Be It Enacted by the Legislature of the State of Florida: 16 |

29 | 29 | | Section 1. (1) Notwithstanding s. 561.20(2), Florida 18 |
---|
30 | 30 | | Statutes, or any other provision of law, the Division of 19 |
---|
31 | 31 | | Alcoholic Beverages and Tobacco of the Department of Business 20 |
---|
32 | 32 | | and Professional Regulation shall issue a special al coholic 21 |
---|
33 | 33 | | beverage license to a residential condominium in the Town of 22 |
---|
34 | 34 | | Hillsboro Beach, Broward County, which: 23 |
---|
35 | 35 | | (a) Has no fewer than 50 condominium units in a single 24 |
---|
36 | 36 | | building or multiple buildings under the control and operation 25 |
---|

48 | 48 | | (b) Is wholly owned by or rented to nontransients. 27 |
---|
49 | 49 | | (c) Is licensed as a food service establishment under 28 |
---|
50 | 50 | | chapter 381 or chapter 509, Florida Statutes, and regularly 29 |
---|
51 | 51 | | offers food and beverage amenities to condominium residents. 30 |
---|
52 | 52 | | (2) A special alcoholic beverage license issued under this 31 |
---|
53 | 53 | | section: 32 |
---|
54 | 54 | | (a) Shall be issued only to the person, company, or 33 |
---|
55 | 55 | | corporation that manages the food and beverage operations of the 34 |
---|
56 | 56 | | condominium and not to the association of condominium owners. 35 |
---|
57 | 57 | | (b) Is limited to the provision of alcoholic beverages for 36 |
---|
58 | 58 | | consumption on the premises only to residents of the condominium 37 |
---|
59 | 59 | | and their nonresident guests. 38 |
---|
60 | 60 | | (c) Does not authorize the condominium to sell alcoholic 39 |
---|
61 | 61 | | beverages by the package for off -premises consumption or to sell 40 |
---|
62 | 62 | | alcoholic beverages after the hours of serving or consumption of 41 |
---|
63 | 63 | | food have elapsed. 42 |
---|
64 | 64 | | (3) The Division of Alcoholic Beverages and Tobacco of the 43 |
---|
65 | 65 | | Department of Business and Professional Regulation may regulate 44 |
---|
66 | 66 | | and supervise residential condomin iums to which special 45 |
---|
67 | 67 | | alcoholic beverage licenses have been issued under this section 46 |
---|
68 | 68 | | in accordance with the rules of the division and general law not 47 |
---|
69 | 69 | | inconsistent with this section. The division may revoke or 48 |
---|
70 | 70 | | suspend any such license for violations of the beverage laws and 49 |
---|
71 | 71 | | rules and regulations of this state not inconsistent with this 50 |
---|
