3030 Be It Enacted by the Legislature of the State of Florida: 17

3232 Section 1. Section 47 of section 3 of chapter 2004 -469, 19
3333 Laws of Florida, is amended to read: 20
3434 Section 47. Bids required. — 21
3535 (1) No contract shall be let by the board for the 22
3636 construction or maintenance of any project authorized by this 23
3737 act, nor shall any goods, supplies, or materials to be purchased 24
3838 when the amount thereof to be paid by the said district exceeds 25

5151 the amount provided in section 28 7.017, Florida Statutes, for 26
5252 category two shall exceed $4,000, unless notice of bids is shall 27

6363 bidders to furnish bonds bond with a responsible surety to be 38
6464 approved by the board. Nothing in this section shall prevent the 39
6565 board from undertaking and performing the construction, 40
6666 operation, and maintenance of any project or facility authorized 41
6767 by this act, by the employment of labor, mater ial, and 42
6868 machinery. 43
6969 (2) The provisions of the Consultants' Competitive 44
7070 Negotiation Act, section 287.055, Florida Statutes, apply to 45
7171 contracts for engineering, architecture, landscape architecture, 46
7272 or registered surveying and mapping services let by the b oard. 47
7373 (3) Contracts for maintenance services for any district 48
7474 facility or project shall be subject to competitive bidding 49
7575 requirements when the amount thereof to be paid by the district 50

8989 Statutes, for category two. The district shall adopt rules, 52
9090 policies, or procedures establishing competitive bidding 53
9191 procedures for maintenance services. Contracts for other 54
9292 services shall not be subject to competitive bidding unless the 55
9393 district adopts a rule, policy , or procedure applying 56
9494 competitive bidding procedures to such contracts. 57
9595 (4) The district may apply to the Department of Management 58
9696 Services, or the entity succeeding to the duties of such 59
9797 department, to purchase commodities and contractual services 60
9898 from purchasing agreements established and state term contracts 61
9999 procured pursuant to section 287.057, Florida Statutes, by such 62
100100 department, as provided in section 287.056, Florida Statutes. 63
101101 Section 2. This act shall take effect upon becoming a law. 64
