ENROLLED CS/HB 793 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0793-02-er Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 1 An act relating to the Coral Springs Improvement 2 District, Broward County; amending chapter 2004 -469, 3 Laws of Florida; prohibiting the board of supervisors 4 of the district from receiving bids on certain 5 contracts; providing an exception; requiring the board 6 to comply with certain statutory bidding procedures; 7 authorizing the board to reject all bids if such 8 rejection is in the best interests of the district; 9 providing that competitive bidding for certain 10 contracts is subject to certain statutory provisions; 11 requiring the district to adopt rules; authorizing the 12 district to apply to the Department of Management 13 Services to purchase certain commodities and 14 contractual services; providing an effective date. 15 16 Be It Enacted by the Legislature of the State of Florida: 17 18 Section 1. Section 47 of section 3 of chapter 2004 -469, 19 Laws of Florida, is amended to read: 20 Section 47. Bids required. — 21 (1) No contract shall be let by the board for the 22 construction or maintenance of any project authorized by this 23 act, nor shall any goods, supplies, or materials to be purchased 24 when the amount thereof to be paid by the said district exceeds 25 ENROLLED CS/HB 793 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0793-02-er Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S the amount provided in section 287.017, Florida Statutes, for 26 category two shall exceed $4,000, unless notice of bids is shall 27 be advertised once a week for 2 consecutive weeks in a newspaper 28 in published in Broward County and of general circulation in the 29 county and in the district. The board, if seeking to construct 30 or improve a public building, structure, or other public works, 31 shall comply with the bidding procedures of section 255.20, 32 Florida Statutes, and other applicable general law. , and In each 33 case, the bid of the lowest responsive and responsible bidder 34 shall be accepted, unless all bids are rejected because the bids 35 are too high or the board determines it is in the best interests 36 of the district to reject all bids . The board may require the 37 bidders to furnish bonds bond with a responsible surety to be 38 approved by the board. Nothing in this section shall prevent the 39 board from undertaking and performing the construction, 40 operation, and maintenance of any project or facility authorized 41 by this act, by the employment of labor, ma terial, and 42 machinery. 43 (2) The provisions of the Consultants' Competitive 44 Negotiation Act, section 287.055, Florida Statutes, apply to 45 contracts for engineering, architecture, landscape architecture, 46 or registered surveying and mapping services let by th e board. 47 (3) Contracts for maintenance services for any district 48 facility or project shall be subject to competitive bidding 49 requirements when the amount thereof to be paid by the district 50 ENROLLED CS/HB 793 2024 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0793-02-er Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S exceeds the amount provided in section 287.017, Florida 51 Statutes, for category two. The district shall adopt rules, 52 policies, or procedures establishing competitive bidding 53 procedures for maintenance services. Contracts for other 54 services shall not be subject to competitive bidding unless the 55 district adopts a rule, pol icy, or procedure applying 56 competitive bidding procedures to such contracts. 57 (4) The district may apply to the Department of Management 58 Services, or the entity succeeding to the duties of such 59 department, to purchase commodities and contractual services 60 from purchasing agreements established and state term contracts 61 procured pursuant to section 287.057, Florida Statutes, by such 62 department, as provided in section 287.056, Florida Statutes. 63 Section 2. This act shall take effect upon becoming a law. 64
