2323 Be It Enacted by the Legislature of the State of Florida: 12

2525 Section 1. Paragraph (b) of subsection (2), paragraph (h) 14
2626 of subsection (4), and subsection (5) of section 2 of chapter 15
2727 82-375, Laws of Florida, as amended by chapters 90 -463 and 2002-16
2828 373, Laws of Florida, are amended to read: 17
2929 Section 2. The following is the charter of the Municipal 18
3030 Service District of Ponte Vedra Beach: 19

3232 (b) At the 1990 general election, seven District Trustees 21
3333 shall be elected by the qualified voters of the district, with 22
3434 three for 2-year terms and four for 4 -year terms, and they shall 23
3535 be elected to serve until their successors are elected and 24
3636 qualified. The seats shall be numbered consecutively one th rough 25

4747 seven. In the 1990 general election, the odd numbered seats 26
4848 shall be elected for terms of 4 years, the even numbered seats 27
4949 for terms of 2 years. The term of office of the District 28
5050 Trustees elected at each succeeding election shall be 4 years , 29
5151 except that a person may not appear on the ballot for reelection 30
5252 to the office of Trustee if, by the end of his or her current 31
5353 term of office, the person will have served, or but for 32
5454 resignation would have served, in that office for a total of 12 33
5555 years, provided that any Trustee currently in office and serving 34
5656 an unexpired term in office will be permitted to complete that 35
5757 term in office. To be eligible for election, a person must 36
5858 reside in the district and be qualified to vote in the district. 37
5959 A trustee may not se rve more than two consecutive 4 -year terms. 38
6060 (4) The district is authorized and empowered: 39
6161 (h) To acquire, construct, operate, maintain, equip, 40
6262 improve, extend, enlarge, or improve capital projects within or 41
6363 without the district for the purposes of enab ling the district 42
6464 to perform the specialized public functions or services as 43
6565 herein provided. However, expenditures on any individual capital 44
6666 project, including acquisition of real or personal property, 45
6767 that exceed exceeds a total cost of $150,000 or 25 percent of 46
6868 the district's current annual budgeted expenses, whichever is 47
6969 greater, must first be approved by a voting majority of 48
7070 qualified voters in the district. The Board of District Trustees 49
7171 shall determine the method to be used to determine whether 50

8282 voters approve a capital expenditure or expenditures exceeding 51
8383 $150,000 or 25 percent of the district's current annual budgeted 52
8484 expenses, whichever is greater, and approval of a majority of 53
8585 those voters participating in or responding to the method used 54
8686 by the District Trustees to decide the issue shall be sufficient 55
8787 to approve expenditure of funds exceeding $150,000 for the 56
8888 project. Whatever method is used to determine voter approval of 57
8989 such expenditure, the District Trustees in presenting the issue 58
9090 to be decided shall generally describe the project to be 59
9191 undertaken by the expenditure and the estimated cost thereof. In 60
9292 addition, the Board of District Trustees shall not expend more 61
9393 than $50,000 from contingency reserves for any unbudgeted 62
9494 capital project in any fi scal year; 63
9595 (5) "Contingency reserves," defined as the amount of funds 64
9696 remaining at the end of the fiscal year , less the amount 65
9797 required to operate the district at the beginning of the next 66
9898 fiscal year, shall not exceed $200,000 or 25 percent of the 67
9999 district's current annual budgeted expenses, whichever is 68
100100 greater, in any fiscal year. Any amount of contingency reserves 69
101101 exceeding $200,000 or 25 percent of the district's current 70
102102 annual budgeted expenses, whichever is greater, at the end of 71
103103 any fiscal year must be used to reduce the ad valorem tax levy 72
104104 for the entire district for the following fiscal year. 73
105105 Section 2. This act shall take effect October 1, 2024. 74
