25 | 25 | | Section 1. Paragraph (b) of subsection (2), paragraph (h) 14 |

29 | 29 | | Section 2. The following is the charter of the Municipal 18 |

32 | 32 | | (b) At the 1990 general election, seven District Trustees 21 |
---|
33 | 33 | | shall be elected by the qualified voters of the district, with 22 |
---|
34 | 34 | | three for 2-year terms and four for 4 -year terms, and they shall 23 |
---|
35 | 35 | | be elected to serve until their successors are elected and 24 |
---|
36 | 36 | | qualified. The seats shall be numbered consecutively one th rough 25 |

47 | 47 | | seven. In the 1990 general election, the odd numbered seats 26 |

50 | 50 | | Trustees elected at each succeeding election shall be 4 years , 29 |

51 | 51 | | except that a person may not appear on the ballot for reelection 30 |

52 | 52 | | to the office of Trustee if, by the end of his or her current 31 |

53 | 53 | | term of office, the person will have served, or but for 32 |

---|
56 | 56 | | an unexpired term in office will be permitted to complete that 35 |

57 | 57 | | term in office. To be eligible for election, a person must 36 |

58 | 58 | | reside in the district and be qualified to vote in the district. 37 |

59 | 59 | | A trustee may not se rve more than two consecutive 4 -year terms. 38 |

60 | 60 | | (4) The district is authorized and empowered: 39 |
---|
61 | 61 | | (h) To acquire, construct, operate, maintain, equip, 40 |
---|
62 | 62 | | improve, extend, enlarge, or improve capital projects within or 41 |
---|
63 | 63 | | without the district for the purposes of enab ling the district 42 |
---|
64 | 64 | | to perform the specialized public functions or services as 43 |
---|
65 | 65 | | herein provided. However, expenditures on any individual capital 44 |
---|
66 | 66 | | project, including acquisition of real or personal property, 45 |
---|
67 | 67 | | that exceed exceeds a total cost of $150,000 or 25 percent of 46 |
---|
68 | 68 | | the district's current annual budgeted expenses, whichever is 47 |
---|
69 | 69 | | greater, must first be approved by a voting majority of 48 |
---|
70 | 70 | | qualified voters in the district. The Board of District Trustees 49 |

88 | 88 | | project. Whatever method is used to determine voter approval of 57 |

89 | 89 | | such expenditure, the District Trustees in presenting the issue 58 |

90 | 90 | | to be decided shall generally describe the project to be 59 |

91 | 91 | | undertaken by the expenditure and the estimated cost thereof. In 60 |
---|
92 | 92 | | addition, the Board of District Trustees shall not expend more 61 |
---|
93 | 93 | | than $50,000 from contingency reserves for any unbudgeted 62 |
---|
94 | 94 | | capital project in any fi scal year; 63 |
---|
95 | 95 | | (5) "Contingency reserves," defined as the amount of funds 64 |
---|
96 | 96 | | remaining at the end of the fiscal year , less the amount 65 |
---|
97 | 97 | | required to operate the district at the beginning of the next 66 |
---|
98 | 98 | | fiscal year, shall not exceed $200,000 or 25 percent of the 67 |
---|
99 | 99 | | district's current annual budgeted expenses, whichever is 68 |
---|
100 | 100 | | greater, in any fiscal year. Any amount of contingency reserves 69 |
---|
101 | 101 | | exceeding $200,000 or 25 percent of the district's current 70 |
---|
102 | 102 | | annual budgeted expenses, whichever is greater, at the end of 71 |

103 | 103 | | any fiscal year must be used to reduce the ad valorem tax levy 72 |

104 | 104 | | for the entire district for the following fiscal year. 73 |
