An act relating to the Municipal Service District of 2 
Ponte Vedra Beach, St. Johns County; amending ch. 82 -3 
375, Laws of Florida, as amended; revising provisions 4 
relating to terms of office of District Trustees; 5 
revising the capital expenditure amount required to be 6 
approved by the voters of the district; revising the 7 
authority of the district to approve such expenditure; 8 
revising a limitation on the amount of the district's 9 
contingency reserves; providing an effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12 
 13 
 Section 1.  Paragraph (b) of subsection (2), paragraph (h) 14 
of subsection (4), and subsection (5) of section 2 of chapter 15 
82-375, Laws of Florida, as amended by chapters 90 -463 and 2002-16 
373, Laws of Florida, are amended to read: 17 
 Section 2.  The following is the charter of the Municipal 18 
Service District of Ponte Vedra Beach: 19 
 (2) 20 
 (b)  At the 1990 general election, seven District Trustees 21 
shall be elected by the qualified voters of the district, with 22 
three for 2-year terms and four for 4 -year terms, and they shall 23 
be elected to serve until their successors are elected and 24 
qualified. The seats shall be numbered consecutively one th rough 25

seven. In the 1990 general election, the odd numbered seats 26 
shall be elected for terms of 4 years, the even numbered seats 27 
for terms of 2 years. The term of office of the District 28 
Trustees elected at each succeeding election shall be 4 years , 29 
except that a person may not appear on the ballot for reelection 30 
to the office of Trustee if, by the end of his or her current 31 
term of office, the person will have served, or but for 32 
resignation would have served, in that office for a total of 12 33 
years, provided that any Trustee currently in office and serving 34 
an unexpired term in office will be permitted to complete that 35 
term in office. To be eligible for election, a person must 36 
reside in the district and be qualified to vote in the district. 37 
A trustee may not se rve more than two consecutive 4 -year terms. 38 
 (4)  The district is authorized and empowered: 39 
 (h)  To acquire, construct, operate, maintain, equip, 40 
improve, extend, enlarge, or improve capital projects within or 41 
without the district for the purposes of enab ling the district 42 
to perform the specialized public functions or services as 43 
herein provided. However, expenditures on any individual capital 44 
project, including acquisition of real or personal property, 45 
that exceed exceeds a total cost of $150,000 or 25 percent of 46 
the district's current annual budgeted expenses, whichever is 47 
greater, must first be approved by a voting majority of 48 
qualified voters in the district. The Board of District Trustees 49 
shall determine the method to be used to determine whether 50

voters approve a capital expenditure or expenditures exceeding 51 
$150,000 or 25 percent of the district's current annual budgeted 52 
expenses, whichever is greater, and approval of a majority of 53 
those voters participating in or responding to the method used 54 
by the District Trustees to decide the issue shall be sufficient 55 
to approve expenditure of funds exceeding $150,000 for the 56 
project. Whatever method is used to determine voter approval of 57 
such expenditure, the District Trustees in presenting the issue 58 
to be decided shall generally describe the project to be 59 
undertaken by the expenditure and the estimated cost thereof. In 60 
addition, the Board of District Trustees shall not expend more 61 
than $50,000 from contingency reserves for any unbudgeted 62 
capital project in any fi scal year; 63 
 (5)  "Contingency reserves," defined as the amount of funds 64 
remaining at the end of the fiscal year , less the amount 65 
required to operate the district at the beginning of the next 66 
fiscal year, shall not exceed $200,000 or 25 percent of the 67 
district's current annual budgeted expenses, whichever is 68 
greater, in any fiscal year. Any amount of contingency reserves 69 
exceeding $200,000 or 25 percent of the district's current 70 
annual budgeted expenses, whichever is greater, at the end of 71 
any fiscal year must be used to reduce the ad valorem tax levy 72 
for the entire district for the following fiscal year. 73 
 Section 2.  This act shall take effect October 1, 2024. 74
