An act relating to storage of firearms in motor 2 
vehicles or vessels; creating s. 790.176, F.S.; 3 
providing definitions; providing requirements for 4 
storage of firearms and ammunition in motor vehicles 5 
or vessels; providing criminal penalties; providing an 6 
effective date. 7

Be It Enacted by the Legislature of the State of Florida: 9 
 10 
 Section 1.  Section 790.176, Florida Statutes, is created 11 
to read: 12 
 790.176  Storage of firearms in motor vehicles or vessels. — 13 
 (1)  As used in this section, the term: 14 
 (a)  "Motor vehicle" has the same meaning as in s. 15 
320.01(1). 16 
 (b)  "Trunk" means the fully enclosed and locked main 17 
storage compartment of a motor vehicle that is not accessible 18 
from the passenger compartment, but does not include any 19 
compartment that has a window; the bed of a pickup truck; or the 20 
rear area of a hatchback, station wagon -type motor vehicle, or 21 
sport utility motor vehicle. 22 
 (c)  "Vessel" has the s ame meaning as in s. 327.02. 23 
 (2)  A person who stores or leaves, in a motor vehicle or 24 
vessel under his or her control, a firearm, whether loaded or 25

unloaded, or firearm ammunition, while the person is not in the 26 
motor vehicle or vessel, shall keep the f irearm from ordinary 27 
observation locked within the trunk, a utility or glove box, or 28 
a locked container securely affixed to the motor vehicle or 29 
vessel.  30 
 (3)  A person who violates subsection (2) commits a 31 
misdemeanor of the second degree, punishable as p rovided in s. 32 
775.082 or s. 775.083. 33 
 Section 2.  This act shall take effect upon becoming a law. 34
