1515 An act relating to millage rates; amending s. 200.065, 2
1616 F.S.; prohibiting certain increases in the millage 3

23-Be It Enacted by the Legislature of the State of Florida: 10

25- Section 1. Paragraph (c) is added to subsection (5) of 12
26-section 200.065, Florida Statutes, to read: 13
27- 200.065 Method of fixing millage. 14
28- (5) In each fiscal year: 15
29- (c) Except as provided in subparagraph (a)2., the prior 16
30-year adopted millage rate may only be increased if approved by a 17
31-two-thirds vote of the membership of the governing body of the 18
32-county, municipality, or independent district. 19

34-Any unit of government operating under a home rule charter 21
35-adopted pursuant to ss. 10, 11, and 24, Art. VIII of the State 22
36-Constitution of 1885, as preserved by s. 6(e), Art. VIII of the 23
37-State Constitution, which is granted the authority in the State 24
38-Constitution to exercise all the powers conferred now or 25

51-hereafter by general law upon municipalities and which exercises 26
52-such powers in the uninc orporated area shall be recognized as a 27
53-municipality under this subsection. For a downtown development 28
54-authority established before the effective date of the State 29
55-Constitution which has a millage that must be approved by a 30
56-municipality, the governing body of that municipality shall be 31
57-considered the governing body of the downtown development 32
58-authority for purposes of this subsection. 33
59- Section 2. (1) The Department of Revenue is authorized, 34
60-and all conditions are deemed met, to adopt emergency rules 35
61-pursuant to s. 120.54(4), Florida Statutes, to implement the 36
62-amendments made by this act to s. 200.065, Florida Statutes. 37
63-Notwithstanding any other provision of law, emergency rules 38
64-adopted pursuant to this subsection are effective for 6 months 39
65-after adoption and may be renewed during the pendency of 40
66-procedures to adopt permanent rules addressing the subject of 41
67-the emergency rules. 42
68- (2) This section shall take effect upon this act becoming 43
69-a law and expires July 1, 2026. 44
70- Section 3. Except as otherwise ex pressly provided in this 45
71-act and except for this section, which shall take effect upon 46
72-this act becoming a law, this act shall take effect July 1, 47
73-2024. 48
