2222 Be It Enacted by the Legislature of the State of Florida: 9

2424 Section 1. Subsections (1) and (3) of section 760.11, 11
2525 Florida Statutes, are amended to read: 12
2626 760.11 Administrative and civil remedies; construction. — 13
2727 (1) Any person aggrieved by a violation of ss. 760.01 -14
2828 760.10 may file a complaint with the commission within 365 days 15
2929 after of the alleged violation, naming the employer, employment 16
3030 agency, labor organization, or joint labor -management committee, 17
3131 or, in the case of an alleged violation of s. 760.10(5), the 18
3232 person responsible for the violation and describing the 19
3333 violation. Any person aggrieved by a violation of s. 509.092 may 20
3434 file a complaint with the commission within 365 days after of 21
3535 the alleged violation naming the person responsible for the 22
3636 violation and describing the violation. The commission, a 23
3737 commissioner, or the Attorney General may in like manner file 24
3838 such a complaint. On the same day the complaint is filed with 25

5151 the commission, the commission shall clearly stamp on the face 26

5353 commission. In lieu of filing the complaint with the commission, 28
5454 a complaint under this section may be filed with the federal 29
5555 Equal Employment Opportunity Commission or with any unit of 30
5656 government of the state which is a fair -employment-practice 31
5757 agency under 29 C.F.R. ss. 1601.70 -1601.80. If the date the 32
5858 complaint is filed is cl early stamped on the face of the 33
5959 complaint, that date is the date of filing. The date the 34
6060 complaint is filed with the commission for purposes of this 35
6161 section is the earliest date of filing with the Equal Employment 36
6262 Opportunity Commission, the fair -employment-practice agency, or 37
6363 the commission. The complaint must shall contain a short and 38
6464 plain statement of the facts describing the violation and the 39
6565 relief sought. The commission may require additional information 40
6666 to be in the complaint. The commission, withi n 5 days after of 41
6767 the complaint being filed, shall by registered mail send a copy 42
6868 of the complaint to the person who allegedly committed the 43
6969 violation. The person who allegedly committed the violation may 44

8888 shall investigate the allegations in the complaint. Within 180 51
8989 days after of the filing of the complaint, the commission shall 52
9090 determine if there is reasonable cause to believe that 53
9191 discriminatory practice has occurred in violation of the Fl orida 54
9292 Civil Rights Act of 1992. When the commission determines whether 55
9393 or not there is reasonable cause, the commission by registered 56
9494 mail shall promptly notify the aggrieved person and the 57
9595 respondent of the reasonable cause determination, the date of 58
9696 such determination, and the options available under this 59
9797 section. 60
9898 Section 2. This act shall take effect July 1, 2024. 61
