21	21	provision of laser hair removal services by certain 8
22	22	health care practitioners; defining the term "l aser 9
23	23	hair removal"; providing an effective date. 10

25	25	Be It Enacted by the Legislature of the State of Florida: 12

27	27	Section 1. Present subsections (4) and (5) of section 14
28	28	458.348, Florida Statutes, are redesignated as subsections (5) 15
29	29	and (6), respectively, and a new subsection (4) is added to that 16
30	30	section, to read: 17
31	31	458.348 Formal supervisory relationships, standing orders, 18
32	32	and established protocols; notice; standards. — 19
33	33	(4) SUPERVISORY RELATIONSHIPS FOR LASER HAIR REMOVAL 20
34	34	SERVICES.—Subsections (2) and (3 ) do not apply to offices 21
35	35	supervised by a physician at which the exclusive service being 22
36	36	performed is laser hair removal by an advanced practice 23
37	37	registered nurse, a physician assistant, a registered nurse, or 24
38	38	a licensed practical nurse. A physician is not required to be 25

52	52	registered nurse, a physician assistant, a registered nurse, or 27
53	53	a licensed practical nurse who provides laser hair removal 28
54	54	services. As used in this subsection, the term "laser hair 29
55	55	removal" means the use of a Class III or Class IV laser device 30
56	56	registered with the department used for nonablative laser hair 31
57	57	removal procedures in which the laser device does not remove the 32
58	58	epidermis; however, the term does not include electrolysis as 33
59	59	defined in s. 478.42. 34
60	60	Section 2. Present subsections (4) and (5) of section 35
61	61	459.025, Florida Statutes, are redesignated as subsections (5) 36
62	62	and (6), respectively, and a new subsection (4) is added to that 37
63	63	section, to read: 38

70	70	practice registered nurse, a physician assistant, a registered 45
71	71	nurse, or a licensed practical nurse. An osteopathic physician 46
72	72	is not required to be physically present while supervising an 47
73	73	advanced practice registered nurse, a physician assistant, a 48
74	74	registered nurse, or a licensed practical nurse who provides 49
75	75	laser hair removal services. As used in this subsection, the 50

90	90	nonablative laser hair removal procedures in which the laser 53

93	93	Section 3. This act shall take effect July 1, 2024. 56
