Present subsections (4) and (5) of section 14 458.348, Florida Statutes, are redesignated as subsections (5) 15 and (6), respectively, and a new subsection (4) is added to that 16 section, to read: 17 458.348 Formal supervisory relationships, standing orders, 18 and established protocols; notice; standards. — 19 (4) SUPERVISORY RELATIONSHIPS FOR LASER HAIR REMOVAL 20 SERVICES.—Subsections (2) and (3 ) do not apply to offices 21 supervised by a physician at which the exclusive service being 22 performed is laser hair removal by an advanced practice 23 registered nurse, a physician assistant, a registered nurse, or 24 a licensed practical nurse. As used in this subsection, the term "laser hair 29 removal" means the use of a Class III or Class IV laser device 30 registered with the department used for nonablative laser hair 31 removal procedures in which the laser device does not remove the 32 epidermis; however, the term does not include electrolysis as 33 defined in s. 478.42. 34 Section 2. Present subsections (4) and (5) of section 35 459.025, Florida Statutes, are redesignated as subsections (5) 36 and (6), respectively, and a new subsection (4) is added to that 37 section, to read: 38 459.025 Formal supervisory relat ionships, standing orders, 39 and established protocols; notice; standards. — 40 (4) SUPERVISORY RELATIONSHIPS FOR LASER HAIR REMOVAL 41 SERVICES.—Subsections (2) and (3) do not apply to offices 42 supervised by an osteopathic physician at which the exclusive 43 service being performed is laser hair removal by an advanced 44 practice registered nurse, a physician assistant, a registered 45 nurse, or a licensed practical nurse. An osteopathic physician 46 is not required to be physically present while supervising an 47 advanced practice registered nurse, a physician assistant, a 48 registered nurse, or a licensed practical nurse who provides 49 laser hair removal services. This act shall take effect July 1, 2024. 56
