An act relating to child support and time -sharing 2 
resulting from unwanted pregnancies; amending s. 3 
390.0111, F.S.; providing requirements for prenatal 4 
care, post birth support, and timesharing for a child 5 
under certain circumstances; providing an effective 6 
date. 7

Be It Enacted by the Legislature of the State of Florida: 9 
 10 
 Section 1.  Subsection (16) is added to section 390.0111, 11 
Florida Statutes, to read: 12 
 390.0111  Termination of pregnancies. — 13 
 (16)  PATERNAL RIGHTS AND CHILD SUPPORT. -- 14 
 (a)  If a victim of rape, incest, or human trafficking is 15 
unable to receive an abortion under this section: 16 
 1.  The offender's paternal rights shall be automatica lly 17 
terminated upon his conviction by a jury or upon a plea of 18 
guilty or nolo contendere; however, the financial obligation of 19 
child support may not be terminated. 20 
 2.  An automatic order for child support shall be entered. 21 
Any support provided by the stat e in support of the child shall 22 
be repaid to the state by the offender. 23 
 (b) If a woman who seeks abortion care is denied such care 24 
because she is beyond the allowable timeframe under this 25

section, she must receive documentation that states she is 26 
beyond the timeframe to receive abortion care. Once she receives 27 
such documentation, she may petition the court for an order of 28 
child support. Upon petition to the court, the order shall be 29 
entered automatically. 30 
 1. The order shall be entered and the child supp ort shall 31 
be at least $350 per month to cover prenatal care. The money 32 
shall be deposited in a depository account with the clerk of 33 
court pending the verification of a DNA test of paternal 34 
parentage. This test can be done prenatal or post birth. Once 35 
paternity is confirmed, the court shall enter an order based 36 
upon the child support calculation methods already set in 37 
general law. 38 
 2. The order shall include financial support for 3 months 39 
post birth. The court shall require financial support of the 40 
child while the mother recovers on maternity leave. The mother 41 
must submit at least 3 months of pay stubs to the court for an 42 
order to be entered to provide up to 50 percent of her income to 43 
the mother for support during maternity leave. 44 
 3. Time-sharing for the child may begin 1 year after the 45 
date the child is born upon a petition to the court or any time 46 
thereafter upon a petition to the court. 47 
 Section 2.  This act shall take effect upon becoming a law. 48
