A bill to be entitled 1 
An act relating to parole; creating s. 947.28, F.S.; 2 
reinstating parole for offenders who solely committed 3 
certain nonviolent felony offenses; providing 4 
exceptions; providing an effective date. 5 
 6 
Be It Enacted by the Legislature of the State of Florida: 7 
 8 
 Section 1.  Section 947.28, Florida Statutes, is created to 9 
read: 10 
 947.28  Parole reinstatement for certain nonviolent felony 11 
offenders.— 12 
 (1)  Notwithstanding any law to the contrary, parole is 13 
reinstated in this state for an offender who solely committed 14 
one or more nonviolent felony of the second degree offenses or 15 
nonviolent felony of the third degree offenses, including, but 16 
not limited to: 17 
 (a)  Drug possession. 18 
 (b)  Theft, grand theft, or larceny. 19 
 (c)  Possession of or trafficking of cannabis as defined in 20 
s. 893.02. 21 
 (d)  Burglary of an unoccupied dwelling, structure, or 22 
conveyance, and he or she was unarmed. 23 
 (2)  Subsection (1) does not app ly to: 24 
 (a)  A person who has been convicted of committing, or 25

attempting, soliciting, or conspiring to commit, any of the 26 
following offenses: 27 
 1.  Section 794.011. 28 
 2.  Chapter 800. 29 
 3.  Section 827.03. 30 
 4.  Section 827.071. 31 
 (b)  A person who was released pursuant to s. 947.1405 or 32 
s. 947.146. 33 
 Section 2.  This act shall take effect July 1, 2024. 34
