Be It Enacted by the Legislature of the State of Florida: 8 
 9 
 Section 1.  Paragraph (a) of subsection (1) of section 10 
893.03, Florida Statutes, is amended to read: 11 
 893.03  Standards and schedules. —The substances enumerated 12 
in this section are controlled by this chapter. The controlled 13 
substances listed or to be listed in Schedules I, II, III, IV, 14 
and V are included by whatever official, common, usual, 15 
chemical, trade name, or class designated. The provisions of 16 
this section shall not be construed to include within any of the 17 
schedules contained in this section any excluded drugs listed 18 
within the purview of 21 C.F.R. s. 1308.22, styled "Excluded 19 
Substances"; 21 C.F.R. s. 1308.24, styled "Exempt Chemical 20 
Preparations"; 21 C.F.R. s. 1308.32, styled "Exempted 21 
Prescription Products"; or 21 C.F.R. s. 1308.34, styled "Exempt 22 
Anabolic Steroid Products." 23 
 (1)  SCHEDULE I.—A substance in Schedule I has a high 24 
potential for abuse and has no currently accepted medical use in 25

treatment in the United States and in its use under medical 26 
supervision does not meet accepted safety standards. The 27 
following substances are controlled in Schedule I: 28 
 (a)  Unless specifically excepted or unle ss listed in 29 
another schedule, any of the following substances, including 30 
their isomers, esters, ethers, salts, and salts of isomers, 31 
esters, and ethers, whenever the existence of such isomers, 32 
esters, ethers, and salts is possible within the specific 33 
chemical designation: 34

 Section 2.  Paragraph (i) of subsec tion (1) of section 201 
893.13, Florida Statutes, is amended to read: 202 
 893.13  Prohibited acts; penalties. — 203 
 (1) 204 
 (i)  Except as authorized by this chapter, a person commits 205 
a felony of the first degree, punishable as provided in s. 206 
775.082, s. 775.083, or s. 775.084, and must be sentenced to a 207 
mandatory minimum term of imprisonment of 3 years, if: 208 
 1.  The person sells, manufactures, or delivers, or 209 
possesses with intent to sell, manufacture, or deliver, any of 210 
the following: 211 
 a.  Alfentanil, as described in s . 893.03(2)(b)1.; 212 
 b.  Carfentanil, as described in s. 893.03(2)(b)6.; 213 
 c.  Fentanyl, as described in s. 893.03(2)(b)9.; 214 
 d.  Sufentanil, as described in s. 893.03(2)(b)30.; 215 
 e.  A fentanyl derivative, as described in s. 216 
893.03(1)(a)63. s. 893.03(1)(a)62.; 217 
 f.  A controlled substance analog, as described in s. 218 
893.0356, of any substance described in sub -subparagraphs a.-e.; 219 
or 220 
 g.  A mixture containing any substance described in sub -221 
subparagraphs a.-f.; and 222 
 2.  The substance or mixture listed in subparagra ph 1. is 223 
in a form that resembles, or is mixed, granulated, absorbed, 224 
spray-dried, or aerosolized as or onto, coated on, in whole or 225

in part, or solubilized with or into, a product, when such 226 
product or its packaging further has at least one of the 227 
following attributes: 228 
 a.  Resembles the trade dress of a branded food product, 229 
consumer food product, or logo food product; 230 
 b.  Incorporates an actual or fake registered copyright, 231 
service mark, or trademark; 232 
 c.  Resembles candy, cereal, a gummy, a vitamin, or a 233 
chewable product, such as a gum or gelatin -based product; or 234 
 d.  Contains a cartoon character imprint. 235 
 Section 3.  Paragraph (a) of subsection (2) of section 236 
893.131, Florida Statutes, is amended to read: 237 
 893.131  Distribution of controlled substan ces resulting in 238 
overdose or serious bodily injury. — 239 
 (2)(a)  Except as provided in paragraph (b), a person 18 240 
years of age or older who unlawfully distributes: 241 
 1.  Heroin, as described in s. 893.03(1)(b)11.; 242 
 2.  Alfentanil, as described in s. 893.03(2)( b)1.; 243 
 3.  Carfentanil, as described in s. 893.03(2)(b)6.; 244 
 4.  Fentanyl, as described in s. 893.03(2)(b)9.; 245 
 5.  Sufentanil, as described in s. 893.03(2)(b)30.; 246 
 6.  Fentanyl derivatives, as described in s. 247 
893.03(1)(a)63. s. 893.03(1)(a)62.; 248 
 7.  A controlled substance analog, as described in s. 249 
893.0356, of any substance specified in subparagraphs 1. -6.; or 250

 8.  A mixture containing any substance specified in 251 
subparagraphs 1.-7., 252

and an overdose or serious bodily injury of the user results, 254 
commits a felony of the second degree, punishable as provided in 255 
s. 775.082, s. 775.083, or s. 775.084, when such substance or 256 
mixture is proven to have caused or been a substantial factor in 257 
causing the overdose or serious bodily injury of the user. 258 
 Section 4.  Paragraph (c) of subsection (1) of section 259 
893.135, Florida Statutes, is amended to read: 260 
 893.135  Trafficking; mandatory sentences; suspension or 261 
reduction of sentences; conspiracy to engage in trafficking. — 262 
 (1)  Except as authorized in this chapter or in chapter 499 263 
and notwithstanding the provisions of s. 893.13: 264 
 (c)1.  A person who knowingly sells, purchases, 265 
manufactures, delivers, or brings into this state, or who is 266 
knowingly in actual or constructive possession of, 4 grams or 267 
more of any morphine, opium, hydromorphone, or any salt, 268 
derivative, isomer, or salt of an isomer thereof, including 269 
heroin, as described in s. 893.03(1)(b), (2)(a), (3)(c)3., or 270 
(3)(c)4., or 4 grams or more of any mixture containing any such 271 
substance, but less than 30 kilogra ms of such substance or 272 
mixture, commits a felony of the first degree, which felony 273 
shall be known as "trafficking in illegal drugs," punishable as 274 
provided in s. 775.082, s. 775.083, or s. 775.084. If the 275

 a.  Is 4 grams or more, but le ss than 14 grams, such person 277 
shall be sentenced to a mandatory minimum term of imprisonment 278 
of 3 years and shall be ordered to pay a fine of $50,000. 279 
 b.  Is 14 grams or more, but less than 28 grams, such 280 
person shall be sentenced to a mandatory minimum t erm of 281 
imprisonment of 15 years and shall be ordered to pay a fine of 282 
$100,000. 283 
 c.  Is 28 grams or more, but less than 30 kilograms, such 284 
person shall be sentenced to a mandatory minimum term of 285 
imprisonment of 25 years and shall be ordered to pay a fine of 286 
$500,000. 287 
 2.  A person who knowingly sells, purchases, manufactures, 288 
delivers, or brings into this state, or who is knowingly in 289 
actual or constructive possession of, 28 grams or more of 290 
hydrocodone, as described in s. 893.03(2)(a)1.k., codeine, as 291 
described in s. 893.03(2)(a)1.g., or any salt thereof, or 28 292 
grams or more of any mixture containing any such substance, 293 
commits a felony of the first degree, which felony shall be 294 
known as "trafficking in hydrocodone," punishable as provided in 295 
s. 775.082, s. 775.083, or s. 775.084. If the quantity involved: 296 
 a.  Is 28 grams or more, but less than 50 grams, such 297 
person shall be sentenced to a mandatory minimum term of 298 
imprisonment of 3 years and shall be ordered to pay a fine of 299 
$50,000. 300

 b.  Is 50 grams or more, but less than 100 grams, such 301 
person shall be sentenced to a mandatory minimum term of 302 
imprisonment of 7 years and shall be ordered to pay a fine of 303 
$100,000. 304 
 c.  Is 100 grams or more, but less than 300 grams, such 305 
person shall be sentenced to a m andatory minimum term of 306 
imprisonment of 15 years and shall be ordered to pay a fine of 307 
$500,000. 308 
 d.  Is 300 grams or more, but less than 30 kilograms, such 309 
person shall be sentenced to a mandatory minimum term of 310 
imprisonment of 25 years and shall be ord ered to pay a fine of 311 
$750,000. 312 
 3.  A person who knowingly sells, purchases, manufactures, 313 
delivers, or brings into this state, or who is knowingly in 314 
actual or constructive possession of, 7 grams or more of 315 
oxycodone, as described in s. 893.03(2)(a)1.q., or any salt 316 
thereof, or 7 grams or more of any mixture containing any such 317 
substance, commits a felony of the first degree, which felony 318 
shall be known as "trafficking in oxycodone," punishable as 319 
provided in s. 775.082, s. 775.083, or s. 775.084. If the 320 
quantity involved: 321 
 a.  Is 7 grams or more, but less than 14 grams, such person 322 
shall be sentenced to a mandatory minimum term of imprisonment 323 
of 3 years and shall be ordered to pay a fine of $50,000. 324 
 b.  Is 14 grams or more, but less than 25 grams, such 325

imprisonment of 7 years and shall be ordered to pay a fine of 327 
$100,000. 328 
 c.  Is 25 grams or more, but less than 100 grams, such 329 
person shall be sentenced to a mandatory minimum term of 330 
imprisonment of 15 years and shall be ordered to pay a fine of 331 
$500,000. 332 
 d.  Is 100 grams or more, but less than 30 kilograms, such 333 
person shall be sentenced to a mandatory minimum term of 334 
imprisonment of 25 years and shall be ordered to pay a fine of 335 
$750,000. 336 
 4.a.  A person who knowingly sells, purchases, 337 
manufactures, delivers, or brings into this state, or who is 338 
knowingly in actual or constructive possession of, 4 grams or 339 
more of: 340 
 (I)  Alfentanil, as described in s. 893.03(2)(b)1.; 341 
 (II)  Carfentanil, as describ ed in s. 893.03(2)(b)6.; 342 
 (III)  Fentanyl, as described in s. 893.03(2)(b)9.; 343 
 (IV)  Sufentanil, as described in s. 893.03(2)(b)30.; 344 
 (V)  A fentanyl derivative, as described in s. 345 
893.03(1)(a)63. s. 893.03(1)(a)62.; 346 
 (VI)  A controlled substance analog, a s described in s. 347 
893.0356, of any substance described in sub -sub-subparagraphs 348 
(I)-(V); or 349 
 (VII)  A mixture containing any substance described in sub -350

commits a felony of the first degree, which felony shall be 353 
known as "trafficking in dangerous fentanyl or fentanyl 354 
analogues," punishable as provided in s. 775.082, s. 775.083, or 355 
s. 775.084. 356 
 b.  If the quantity involved under sub -subparagraph a.: 357 
 (I)  Is 4 grams or more, but less than 14 grams, such 358 
person shall be sentenced to a mandatory minimum term of 359 
imprisonment of 7 years, and shall be ordered to pay a fine of 360 
$50,000. 361 
 (II)  Is 14 grams or more, but less than 28 grams, such 362 
person shall be sentenced to a mandatory minimum term of 363 
imprisonment of 20 years, and shall be ordered to pay a fine of 364 
$100,000. 365 
 (III)  Is 28 grams or more, such person shall be sentenced 366 
to a mandatory minimum term of imprisonment of 25 years, and 367 
shall be ordered to pay a fine of $500,000. 368 
 c.  A person 18 years of age or older who violates sub -369 
subparagraph a. by knowingly selling or delivering to a minor at 370 
least 4 grams of a substance or mixture listed in sub -371 
subparagraph a. shall be sentenced to a mandatory minimum term 372 
of not less than 25 years and not exceeding life imprisonment, 373 
and shall be ordered to pay a fine of $1 million if the 374 
substance or mixture listed in sub -subparagraph a. is in a form 375

solubilized with or i nto, a product, when such product or its 378 
packaging further has at least one of the following attributes: 379 
 (I)  Resembles the trade dress of a branded food product, 380 
consumer food product, or logo food product; 381 
 (II)  Incorporates an actual or fake registere d copyright, 382 
service mark, or trademark; 383 
 (III)  Resembles candy, cereal, a gummy, a vitamin, or a 384 
chewable product, such as a gum or gelatin -based product; or 385 
 (IV)  Contains a cartoon character imprint. 386 
 5.  A person who knowingly sells, purchases, manufactures, 387 
delivers, or brings into this state, or who is knowingly in 388 
actual or constructive possession of, 30 kilograms or more of 389 
any morphine, opium, oxycodone, hydrocodone, codeine, 390 
hydromorphone, or any salt, derivative, isomer, or salt of an 391 
isomer thereof, including heroin, as described in s. 392 
893.03(1)(b), (2)(a), (3)(c)3., or (3)(c)4., or 30 kilograms or 393 
more of any mixture containing any such substance, commits the 394 
first degree felony of trafficking in illegal drugs. A person 395 
who has been convicted of the first degree felony of trafficking 396 
in illegal drugs under this subparagraph shall be punished by 397 
life imprisonment and is ineligible for any form of 398 
discretionary early release except pardon or execu tive clemency 399 
or conditional medical release under s. 947.149. However, if the 400

court determines that, in addition to committing any act 401 
specified in this paragraph: 402 
 a.  The person intentionally killed an individual or 403 
counseled, commanded, induced, procur ed, or caused the 404 
intentional killing of an individual and such killing was the 405 
result; or 406 
 b.  The person's conduct in committing that act led to a 407 
natural, though not inevitable, lethal result, 408 
 409 
such person commits the capital felony of trafficking in il legal 410 
drugs, punishable as provided in ss. 775.082 and 921.142. A 411 
person sentenced for a capital felony under this paragraph shall 412 
also be sentenced to pay the maximum fine provided under 413 
subparagraph 1. 414 
 6.  A person who knowingly brings into this state 6 0 415 
kilograms or more of any morphine, opium, oxycodone, 416 
hydrocodone, codeine, hydromorphone, or any salt, derivative, 417 
isomer, or salt of an isomer thereof, including heroin, as 418 
described in s. 893.03(1)(b), (2)(a), (3)(c)3., or (3)(c)4., or 419 
60 kilograms or more of any mixture containing any such 420 
substance, and who knows that the probable result of such 421 
importation would be the death of a person, commits capital 422 
importation of illegal drugs, a capital felony punishable as 423 
provided in ss. 775.082 and 921.142. A person sentenced for a 424 
capital felony under this paragraph shall also be sentenced to 425

 Section 5.  This act shall take effect July 1, 2024. 427
