2121 Be It Enacted by the Legislature of the State of Florida: 8

2323 Section 1. Section 775.0848, Florida Statutes, is amended 10
2424 to read: 11
2525 775.0848 Commission of a misdemeanor or felony after 12
2626 unlawful reentry into the United States; reclassification. —A 13
2727 person who has been previously convicted of a crime relating to 14
2828 the reentry of removed aliens under 8 U.S.C. s. 1326 shall have 15
2929 the penalty for committing a misdemeanor or felony committed 16
3030 after such conviction reclassified in the following manner: 17
3131 (1) A misdemeanor of the second degree is reclassified to 18
3232 a misdemeanor of the first degree. 19
3333 (2) A misdemeanor of the first degree is reclassified to a 20
3434 felony of the third d egree. 21
3535 (3) A felony of the third degree is reclassified to a 22
3636 felony of the second degree. 23
3737 (4)(2) A felony of the second degree is reclassified to a 24
3838 felony of the first degree. 25

5151 (5)(3) A felony of the first degree is reclassified to a 26
5252 life felony. 27
5353 Section 2. If any provision of this act or its application 28
5454 to any person or circumstance is held invalid, the invalidity 29
5555 does not affect other provisions or applications of this act 30
5656 which can be given effect without the invalid provisions or 31
5757 application, and to this end the provisions of this act are 32
5858 severable. 33
5959 Section 3. This act shall take effect upon becoming a law. 34
