A bill to be entitled 1 
An act relating to combatting illegal immigration; 2 
amending s. 775.0848, F.S.; requiring the penalty 3 
reclassification of certain crimes committed after 4 
unlawful reentry into the United States; providing for 5 
severability; providing an effective date. 6

Be It Enacted by the Legislature of the State of Florida: 8 
 9 
 Section 1.  Section 775.0848, Florida Statutes, is amended 10 
to read: 11 
 775.0848  Commission of a misdemeanor or felony after 12 
unlawful reentry into the United States; reclassification. —A 13 
person who has been previously convicted of a crime relating to 14 
the reentry of removed aliens under 8 U.S.C. s. 1326 shall have 15 
the penalty for committing a misdemeanor or felony committed 16 
after such conviction reclassified in the following manner: 17 
 (1)  A misdemeanor of the second degree is reclassified to 18 
a misdemeanor of the first degree. 19 
 (2)  A misdemeanor of the first degree is reclassified to a 20 
felony of the third d egree. 21 
 (3) A felony of the third degree is reclassified to a 22 
felony of the second degree. 23 
 (4)(2) A felony of the second degree is reclassified to a 24 
felony of the first degree. 25

 (5)(3) A felony of the first degree is reclassified to a 26 
life felony. 27 
 Section 2. If any provision of this act or its application 28 
to any person or circumstance is held invalid, the invalidity 29 
does not affect other provisions or applications of this act 30 
which can be given effect without the invalid provisions or 31 
application, and to this end the provisions of this act are 32 
severable. 33 
 Section 3. This act shall take effect upon becoming a law. 34
