17-"vehicle"; amending s. 316.183, F.S.; providing that a 4

20-motor vehicle, vessel, or other conveyance at a speed 7
21-that creates an excessive wake; providing an effective 8

24-Be It Enacted by the Legisla ture of the State of Florida: 11

26- Section 1. Subsection (109) of section 316.003, Florida 13
27-Statutes, is amended to read: 14
28- 316.003 Definitions. —The following words and phrases, when 15
29-used in this chapter, shall have the meanings respectively 16
30-ascribed to them in this section, except where the context 17
31-otherwise requires: 18
32- (109) VEHICLE.—Every device in, upon, or by which any 19
33-person or property is or may be transported or drawn upon a 20
34-street or highway, except personal delivery devices, mobile 21
35-carriers, and devices used exclusively upon stationary rails or 22
36-tracks. 23
37- Section 2. Subsection (1) of section 316.183, Florida 24
38-Statutes, is amended to read: 25

51- 316.183 Unlawful speed. — 26
52- (1) No person shall drive a vehicle on a street or highway 27
53-at a speed greater than is reasonable and prudent under the 28
54-conditions and having regard to the actual and potential hazards 29
55-then existing. In every event, speed shall be controlled as may 30
56-be necessary to avoid colliding with any person, vehicle, or 31
57-other conveyance or object on or entering the street or highway 32
58-in compliance with legal requirements and the duty of all 33
59-persons to use due care. 34
60- Section 3. Section 316.88, Florida Statutes, is created to 35
61-read: 36
62- 316.88 Creation of a wake on streets or highways. —A person 37
63-may not operate a motor vehicle, vessel, or any other conveyance 38
64-at a speed that creates an excessive wake on a flooded or 39
65-inundated street or highway. 40
66- Section 4. This act shall take effect upon becoming a law. 41

23+ Section 1. Subsection (5) of section 316.183, Florida 10
24+Statutes, is amended to read: 11
25+ 316.183 Unlawful speed. — 12
26+ (5) A No person may not shall drive a motor vehicle at 13
27+such a slow speed as to impede or block the normal and 14
28+reasonable movement of traffic, except when reduced speed is 15
29+necessary for safe operation or in compliance with law , 16
30+including, notwithstanding subs ection (2), a local ordinance 17
31+regarding the operation of a motor vehicle, boat, or any other 18
32+conveyance on flooded or inundated streets . 19
33+ Section 2. This act shall take effect upon becoming a law. 20
