A bill to be entitled 1 
An act relating to operating vehicles and vessels; 2 
amending s. 316.003, F.S.; revising the definition of 3 
"vehicle"; amending s. 316.183, F.S.; providing that a 4 
person may not drive on a street at an unlawful speed; 5 
creating s. 316.88, F.S.; prohibiting operation of a 6 
motor vehicle, vessel, or other conveyance at a speed 7 
that creates an excessive wake; providing an effective 8 
date. 9

Be It Enacted by the Legisla ture of the State of Florida: 11 
 12 
 Section 1.  Subsection (109) of section 316.003, Florida 13 
Statutes, is amended to read: 14 
 316.003  Definitions. —The following words and phrases, when 15 
used in this chapter, shall have the meanings respectively 16 
ascribed to them in this section, except where the context 17 
otherwise requires: 18 
 (109)  VEHICLE.—Every device in, upon, or by which any 19 
person or property is or may be transported or drawn upon a 20 
street or highway, except personal delivery devices, mobile 21 
carriers, and devices used exclusively upon stationary rails or 22 
tracks. 23 
 Section 2.  Subsection (1) of section 316.183, Florida 24 
Statutes, is amended to read: 25

 316.183  Unlawful speed. — 26 
 (1)  No person shall drive a vehicle on a street or highway 27 
at a speed greater than is reasonable and prudent under the 28 
conditions and having regard to the actual and potential hazards 29 
then existing. In every event, speed shall be controlled as may 30 
be necessary to avoid colliding with any person, vehicle, or 31 
other conveyance or object on or entering the street or highway 32 
in compliance with legal requirements and the duty of all 33 
persons to use due care. 34 
 Section 3.  Section 316.88, Florida Statutes, is created to 35 
read: 36 
 316.88  Creation of a wake on streets or highways. —A person 37 
may not operate a motor vehicle, vessel, or any other conveyance 38 
at a speed that creates an excessive wake on a flooded or 39 
inundated street or highway. 40 
 Section 4. This act shall take effect upon becoming a law. 41
