2828 Section 1. Subsection (136) is added to section 320.08058, 15
2929 Florida Statutes, to read: 16
3030 320.08058 Specialty license plates. — 17
3131 (136) SUPPORTING FHP TROOPERS LICENSE PLATES. — 18
3232 (a) The department shall develop a Supporting FHP Troopers 19
3333 license plate as provided in this section and s. 320.08053. The 20
3434 plate must bear the colors and design approved by the 21
3535 department. The word "Florida" must appear a t the top of the 22
3636 plate, and the words "Supporting FHP Troopers" must appear at 23
3737 the bottom of the plate. 24
3838 (b) The annual use fees from the sale of the plate must be 25

5151 distributed to the Florida Highway Patrol Advisory Council, 26
5252 Inc., a nonprofit organization under s. 501(c)(3) of the 27
5353 Internal Revenue Code, which may use up to 10 percent of the 28
5454 fees for administrative costs and marketing of the plate. The 29
5555 Florida Highway Patrol Advisory Council, Inc., must use the 30
5656 remaining fees to fund scholarships, based on t he council's 31
5757 established criteria, for current members of the Florida Highway 32
5858 Patrol and their family members who are attending a vocational 33
5959 school, technical school, college, or university. For purposes 34
6060 of this paragraph, the term "family member" means a spouse, 35
6161 child, stepchild, legally adopted child, or child raised in the 36
6262 home and claimed by the Florida Highway Patrol member as a 37
6363 dependent under the federal income tax code before the child's 38
6464 18th birthday. 39
6565 Section 2. Paragraph (b) of subsection (2) of section 40
6666 320.08053, Florida Statutes, is amended to read: 41

6969 (b) Within 24 months after the presale specialty license 44
7070 plate voucher is established, the approved specialty license 45
7171 plate organization must record with the department a minimum of 46
7272 3,000 voucher sales before manufacture of the license plate may 47
7373 commence. The department shall extend this presale period by an 48
7474 additional 24 months for an approved specialty license plate 49

8888 but has not recorded at least 3,000 voucher sales. If, at the 51
8989 conclusion of the presale period, the minimum sales requirement 52
9090 has not been met, the specialty plate is deauthorized, and the 53
9191 department shall dis continue development of the plate and 54
9292 discontinue issuance of the presale vouchers. Upon 55
9393 deauthorization of the license plate or if the plate has met the 56
9494 presale requirement but has not been issued, a purchaser of the 57
9595 license plate voucher may use the annu al use fee collected as a 58
9696 credit towards any other specialty license plate or apply for a 59
9797 refund on a form prescribed by the department. This paragraph 60
9898 does not apply to the Supporting FHP Troopers license plate 61
9999 established under s. 320.08058(136). 62
100100 Section 3. Paragraph (a) of subsection (8) of section 63
101101 320.08056, Florida Statutes, is amended to read: 64

103103 (8)(a) The department must discontinue the issuance of an 66
104104 approved specialty license plate if the number of valid 67
105105 specialty plate registrations falls below 3,000, or in the case 68
106106 of an out-of-state college or university license plate, 4,000, 69
107107 for at least 12 consecutive months. The department shall mail a 70
108108 warning letter to the sponsoring organization following the 71
109109 first month in which the total number of valid specialty plate 72
110110 registrations is below 3,000, or in the case of an out -of-state 73
111111 college or university license plate, 4,000. This paragraph does 74
