28	28	Section 1. Subsection (136) is added to section 320.08058, 15
29	29	Florida Statutes, to read: 16
30	30	320.08058 Specialty license plates. — 17
31	31	(136) SUPPORTING FHP TROOPERS LICENSE PLATES. — 18
32	32	(a) The department shall develop a Supporting FHP Troopers 19
33	33	license plate as provided in this section and s. 320.08053. The 20
34	34	plate must bear the colors and design approved by the 21
35	35	department. The word "Florida" must appear a t the top of the 22
36	36	plate, and the words "Supporting FHP Troopers" must appear at 23
37	37	the bottom of the plate. 24

51	51	distributed to the Florida Highway Patrol Advisory Council, 26
52	52	Inc., a nonprofit organization under s. 501(c)(3) of the 27
53	53	Internal Revenue Code, which may use up to 10 percent of the 28
54	54	fees for administrative costs and marketing of the plate. The 29
55	55	Florida Highway Patrol Advisory Council, Inc., must use the 30
56	56	remaining fees to fund scholarships, based on t he council's 31
57	57	established criteria, for current members of the Florida Highway 32
58	58	Patrol and their family members who are attending a vocational 33
59	59	school, technical school, college, or university. For purposes 34
60	60	of this paragraph, the term "family member" means a spouse, 35
61	61	child, stepchild, legally adopted child, or child raised in the 36
62	62	home and claimed by the Florida Highway Patrol member as a 37
63	63	dependent under the federal income tax code before the child's 38
64	64	18th birthday. 39
65	65	Section 2. Paragraph (b) of subsection (2) of section 40
66	66	320.08053, Florida Statutes, is amended to read: 41
67	67	320.08053 Establishment of specialty license plates. — 42

69	69	(b) Within 24 months after the presale specialty license 44
70	70	plate voucher is established, the approved specialty license 45
71	71	plate organization must record with the department a minimum of 46
72	72	3,000 voucher sales before manufacture of the license plate may 47
73	73	commence. The department shall extend this presale period by an 48
74	74	additional 24 months for an approved specialty license plate 49
75	75	organization that, as of June 15, 2022, is in the presale period 50

88	88	but has not recorded at least 3,000 voucher sales. If, at the 51
89	89	conclusion of the presale period, the minimum sales requirement 52
90	90	has not been met, the specialty plate is deauthorized, and the 53
91	91	department shall dis continue development of the plate and 54
92	92	discontinue issuance of the presale vouchers. Upon 55
93	93	deauthorization of the license plate or if the plate has met the 56
94	94	presale requirement but has not been issued, a purchaser of the 57
95	95	license plate voucher may use the annu al use fee collected as a 58
96	96	credit towards any other specialty license plate or apply for a 59
97	97	refund on a form prescribed by the department. This paragraph 60
98	98	does not apply to the Supporting FHP Troopers license plate 61
99	99	established under s. 320.08058(136). 62
100	100	Section 3. Paragraph (a) of subsection (8) of section 63
101	101	320.08056, Florida Statutes, is amended to read: 64
102	102	320.08056 Specialty license plates. — 65
103	103	(8)(a) The department must discontinue the issuance of an 66
104	104	approved specialty license plate if the number of valid 67
105	105	specialty plate registrations falls below 3,000, or in the case 68
106	106	of an out-of-state college or university license plate, 4,000, 69
107	107	for at least 12 consecutive months. The department shall mail a 70
108	108	warning letter to the sponsoring organization following the 71
109	109	first month in which the total number of valid specialty plate 72
110	110	registrations is below 3,000, or in the case of an out -of-state 73
111	111	college or university license plate, 4,000. This paragraph does 74
