An act relating to specialty license plates; amending 2 
s. 320.08058, F.S.; directing the Department of 3 
Highway Safety and Motor Vehicles to develop a 4 
Supporting FHP Troopers license plate; providing for 5 
distribution and use of fees collected from the sale 6 
of the plate; amending ss. 320.08053 and 320.08056, 7 
F.S.; exempting the plate from minimum presale voucher 8 
requirements and minimum valid registration 9 
requirements, respectively; providing an effective 10 
date. 11

Be It Enacted by the Legislature of the State of Florida: 13 
 14 
 Section 1.  Subsection (136) is added to section 320.08058, 15 
Florida Statutes, to read: 16 
 320.08058  Specialty license plates. — 17 
 (136)  SUPPORTING FHP TROOPERS LICENSE PLATES. — 18 
 (a)  The department shall develop a Supporting FHP Troopers 19 
license plate as provided in this section and s. 320.08053. The 20 
plate must bear the colors and design approved by the 21 
department. The word "Florida" must appear a t the top of the 22 
plate, and the words "Supporting FHP Troopers" must appear at 23 
the bottom of the plate. 24 
 (b)  The annual use fees from the sale of the plate must be 25

distributed to the Florida Highway Patrol Advisory Council, 26 
Inc., a nonprofit organization under s. 501(c)(3) of the 27 
Internal Revenue Code, which may use up to 10 percent of the 28 
fees for administrative costs and marketing of the plate. The 29 
Florida Highway Patrol Advisory Council, Inc., must use the 30 
remaining fees to fund scholarships, based on t he council's 31 
established criteria, for current members of the Florida Highway 32 
Patrol and their family members who are attending a vocational 33 
school, technical school, college, or university. For purposes 34 
of this paragraph, the term "family member" means a spouse, 35 
child, stepchild, legally adopted child, or child raised in the 36 
home and claimed by the Florida Highway Patrol member as a 37 
dependent under the federal income tax code before the child's 38 
18th birthday. 39 
 Section 2.  Paragraph (b) of subsection (2) of section 40 
320.08053, Florida Statutes, is amended to read: 41 
 320.08053  Establishment of specialty license plates. — 42 
 (2) 43 
 (b)  Within 24 months after the presale specialty license 44 
plate voucher is established, the approved specialty license 45 
plate organization must record with the department a minimum of 46 
3,000 voucher sales before manufacture of the license plate may 47 
commence. The department shall extend this presale period by an 48 
additional 24 months for an approved specialty license plate 49 
organization that, as of June 15, 2022, is in the presale period 50

but has not recorded at least 3,000 voucher sales. If, at the 51 
conclusion of the presale period, the minimum sales requirement 52 
has not been met, the specialty plate is deauthorized, and the 53 
department shall dis continue development of the plate and 54 
discontinue issuance of the presale vouchers. Upon 55 
deauthorization of the license plate or if the plate has met the 56 
presale requirement but has not been issued, a purchaser of the 57 
license plate voucher may use the annu al use fee collected as a 58 
credit towards any other specialty license plate or apply for a 59 
refund on a form prescribed by the department. This paragraph 60 
does not apply to the Supporting FHP Troopers license plate 61 
established under s. 320.08058(136). 62 
 Section 3.  Paragraph (a) of subsection (8) of section 63 
320.08056, Florida Statutes, is amended to read: 64 
 320.08056  Specialty license plates. — 65 
 (8)(a)  The department must discontinue the issuance of an 66 
approved specialty license plate if the number of valid 67 
specialty plate registrations falls below 3,000, or in the case 68 
of an out-of-state college or university license plate, 4,000, 69 
for at least 12 consecutive months. The department shall mail a 70 
warning letter to the sponsoring organization following the 71 
first month in which the total number of valid specialty plate 72 
registrations is below 3,000, or in the case of an out -of-state 73 
college or university license plate, 4,000. This paragraph does 74 
not apply to: 75

 1. In-state collegiate license plates established under s. 76 
320.08058(3)., 77 
 2. License plates of institutions in and entities of the 78 
State University System ., 79 
 3. Specialty license plates that have statutory 80 
eligibility limitations for purchase ., 81 
 4. Specialty license plates for which annual use fees are 82 
distributed by a foundation for student and teacher leadership 83 
programs and teacher recruitment and retention ., or 84 
 5. Florida Professional Sports Team license plates 85 
established under s. 320.08058(9). 86 
 6.  The Supporting FHP Troopers license plate established 87 
under s. 320.08058(136). 88 
 Section 4. This act shall take effect October 1, 2025. 89
