25	25	requiring drug wholesalers and distributors to sell 12
26	26	specified drugs to Medicaid pharmacies at 340B Drug 13

37	37	Section 1. Section 409.9067, Florida Statutes, is created 24

52	52	Pricing Program.— 27
53	53	(1)(a) A drug manufacturer must sell a drug to a Medicaid 28
54	54	pharmacy at the 340B Drug Pricing Program discounted price or 29
55	55	less if the drug is: 30
56	56	1. On the Medicaid preferred drug list as described in s. 31
57	57	409.912(5); and 32
58	58	2. A covered drug under the 340B Drug Pricing Program. 33
59	59	(b) The drug described in paragraph (a) may be delivered 34
60	60	to the Medicaid pharmacy in any method that the drug 35
61	61	manufacturer uses. 36
62	62	(c) If a drug manufacturer sells a drug as described in 37
63	63	paragraph (a) to a Medicaid pharmacy at the 340B Drug Pricing 38
64	64	Program discounted p rice and the discounted price is higher than 39
65	65	the state Medicaid negotiated price, the drug manufacturer shall 40
66	66	pay a rebate to the state to comply with the state Medicaid 41
67	67	negotiated price. 42
68	68	(2) A pharmacy benefits manager participating in the 43
69	69	Medicaid program shall pay a Medicaid pharmacy the 340B Drug 44
70	70	Pricing Program discounted price plus the professional 45
71	71	dispensing fee as determined in rule 59G -4.251, F.A.C., as 46
72	72	amended, for any drug that is on the Medicaid preferred drug 47
73	73	list as described in s. 409.912(5 ) and that is a covered drug 48
74	74	under the 340B Drug Pricing Program. 49
75	75	(3)(a) A drug wholesaler or distributor must sell a drug 50

88	88	to a Medicaid pharmacy at the 340B Drug Pricing Program 51

90	90	1. On the Medicaid preferred drug list a s described in s. 53
91	91	409.912(5); and 54
92	92	2. A covered drug under the 340B Drug Pricing Program. 55
93	93	(b) A drug wholesaler or distributor may not change a 56
94	94	current pricing model or program that is in place with a 57
95	95	Medicaid pharmacy by exempting the drug described in paragraph 58
96	96	(a) from the pricing model or program or referencing such drug 59
97	97	in any way in the pricing model or program. 60
98	98	(4) A Medicaid pharmacy may provide a covered drug at the 61
99	99	340B Drug Pricing Program discounted price only to Medicaid 62
100	100	recipients. 63
101	101	Section 2. This act shall take effect January 1, 2026. 64
