A bill to be entitled 1 
An act relating to Medicaid pharmacy discounted drug 2 
prices; creating s. 409.9067, F.S.; requiring drug 3 
manufacturers to sell specified drugs to Medicaid 4 
pharmacies at 340B Drug Pricing Program discounted 5 
prices; providing delivery methods for such drugs; 6 
requiring drug manufacturers to pay rebates to the 7 
state under certain circumstances; requiring pharmacy 8 
benefits managers participating in the Medicaid 9 
program to pay Medicaid pharmacies for specified drugs 10 
at 340B Drug Pricing Program discounted prices; 11 
requiring drug wholesalers and distributors to sell 12 
specified drugs to Medicaid pharmacies at 340B Drug 13 
Pricing Program discounted prices; prohibiting dru g 14 
wholesalers and distributors from changing current 15 
pricing models and programs by engaging in certain 16 
acts; limiting the sales by Medicaid pharmacies of 17 
specified drugs at 340 Drug Pricing Program discounted 18 
prices to Medicaid recipients; providing an ef fective 19 
date. 20

Be It Enacted by the Legislature of the State of Florida: 22 
 23 
 Section 1.  Section 409.9067, Florida Statutes, is created 24 
to read: 25

 409.9067  Discounted drug prices under the 340B Drug 26 
Pricing Program.— 27 
 (1)(a)  A drug manufacturer must sell a drug to a Medicaid 28 
pharmacy at the 340B Drug Pricing Program discounted price or 29 
less if the drug is: 30 
 1.  On the Medicaid preferred drug list as described in s. 31 
409.912(5); and 32 
 2.  A covered drug under the 340B Drug Pricing Program. 33 
 (b)  The drug described in paragraph (a) may be delivered 34 
to the Medicaid pharmacy in any method that the drug 35 
manufacturer uses. 36 
 (c)  If a drug manufacturer sells a drug as described in 37 
paragraph (a) to a Medicaid pharmacy at the 340B Drug Pricing 38 
Program discounted p rice and the discounted price is higher than 39 
the state Medicaid negotiated price, the drug manufacturer shall 40 
pay a rebate to the state to comply with the state Medicaid 41 
negotiated price. 42 
 (2)  A pharmacy benefits manager participating in the 43 
Medicaid program shall pay a Medicaid pharmacy the 340B Drug 44 
Pricing Program discounted price plus the professional 45 
dispensing fee as determined in rule 59G -4.251, F.A.C., as 46 
amended, for any drug that is on the Medicaid preferred drug 47 
list as described in s. 409.912(5 ) and that is a covered drug 48 
under the 340B Drug Pricing Program. 49 
 (3)(a)  A drug wholesaler or distributor must sell a drug 50

to a Medicaid pharmacy at the 340B Drug Pricing Program 51 
discounted price if the drug is: 52 
 1.  On the Medicaid preferred drug list a s described in s. 53 
409.912(5); and 54 
 2.  A covered drug under the 340B Drug Pricing Program. 55 
 (b)  A drug wholesaler or distributor may not change a 56 
current pricing model or program that is in place with a 57 
Medicaid pharmacy by exempting the drug described in paragraph 58 
(a) from the pricing model or program or referencing such drug 59 
in any way in the pricing model or program. 60 
 (4)  A Medicaid pharmacy may provide a covered drug at the 61 
340B Drug Pricing Program discounted price only to Medicaid 62 
recipients. 63 
 Section 2. This act shall take effect January 1, 2026. 64
