A bill to be entitled 1 
An act relating to anchoring and mooring at seaports; 2 
creating s. 311.104, F.S.; authorizing certain 3 
seaports to designate no anchoring or mooring zones 4 
for certain boats anchored in certain waters for a 5 
specified time period for specified purposes; 6 
specifying boundary limits for no anchoring or mooring 7 
zones; authorizing certain seaports to apply to the 8 
Fish and Wildlife Conservation Commission to establish 9 
no anchoring or mooring zones; requiring an applicant 10 
to hold a specified number of public hearings; 11 
requiring the commission to consult with other 12 
entities; authorizing the commission to modify no 13 
anchoring or mooring zone boundaries; requiring 14 
certain seaports to annually review the boundaries of 15 
approved no anchoring or mooring zones and submit a 16 
revised application under certain circumstances; 17 
requiring certain information to be included in 18 
seaport security plans and seaport strategic plans; 19 
providing an effective date. 20

Be It Enacted by the Legislature of the State of Florida: 22 
 23 
 Section 1.  Section 311.104, Florida Statutes, is created 24 
to read: 25

 311.104  Designation of no anchoring or mooring zones. — 26 
 (1)  Each seaport listed in s. 311.09(1) may de signate no 27 
anchoring or mooring zones for uninsured boats anchored for more 28 
than 45 days in the waters surrounding the seaport as required 29 
in s. 327.4109 for all of the following purposes: 30 
 (a)  Implementing port security measures. 31 
 (b)  Ensuring freight a nd passenger commerce is not 32 
impeded. 33 
 (c)  Promoting the safety and security of residents and 34 
visitors of this state. 35 
 (d)  Maintaining and protecting the flow of legitimate 36 
trade and travel at all times. 37 
 (2)  The boundary of any designated no anchoring or mooring 38 
zone may not exceed: 39 
 (a)  Within the navigational harbor of the seaport, 1,250 40 
feet from a navigation channel that provides entrance to the 41 
harbor or from a pier or wharf adjacent to a navigation channel 42 
or turning basin; or 43 
 (b)  Beyond the navigational harbor of the seaport, 500 44 
feet from a navigation channel that provides entrance to the 45 
harbor. 46

The navigational harbor of the seaport includes navigation 48 
channels, turning basins, navigation aids, and breakwaters and 49 
jetties. 50

 (3)  A seaport listed in s. 311.09(1) may apply, pursuant 51 
to chapter 327, to the Fish and Wildlife Conservation Commission 52 
to establish a no anchoring or mooring zone. 53 
 (4)  Before applying to the Fish and Wildlife Conservation 54 
Commission to establish a no anchoring or m ooring zone, an 55 
applicant must hold at least two public hearings displaying the 56 
boundaries of the proposed no anchoring or mooring zone. 57 
 (5)  The Fish and Wildlife Conservation Commission shall 58 
consult with the United States Coast Guard, the United States 59 
Army Corps of Engineers, and the Department of Transportation 60 
when considering an application for, and the boundaries of, a no 61 
anchoring or mooring zone. 62 
 (6)  When considering an application for a no anchoring or 63 
mooring zone, the Fish and Wildlife Conse rvation Commission may 64 
modify the proposed boundaries of such no anchoring or mooring 65 
zone. 66 
 (7)  After approval of a no anchoring or mooring zone, the 67 
seaport must review the no anchoring or mooring zone boundaries 68 
annually, and if necessary, submit a rev ised application to the 69 
Fish and Wildlife Conservation Commission with any proposed 70 
modifications to the boundaries. 71 
 (8)  Each seaport must include in its seaport security plan 72 
and in its seaport strategic plan, as required under ss. 311.12 73 
and 311.14, respectively, any approved no anchoring or mooring 74 
zones that are in effect. 75

 Section 2. This act shall take effect July 1, 2025. 76
