1515 An act relating to deceptive and unfair trade acts or 2

2323 Be It Enacted by the Legislature of the State of Fl orida: 10

2525 Section 1. Section 501.2043, Florida Statutes, is created 12
2626 to read: 13
2727 501.2043 Unlawful acts and practices by advertisers. — 14
2828 (1) Beginning January 1, 2026, a person, a firm, a 15
2929 corporation, an association, or any other entity, or an agent or 16
3030 employee thereof, in a transaction that is intended to result in 17
3131 or actually results in the sale or lease of goods or services to 18
3232 a consumer, commits an unfair or deceptive act or practice as 19
3333 specified in s. 501.204 if such person or entity intentionally 20
3434 does any of the following: 21
3535 (a) Advertises, displays, or offers a price for a good or 22
3636 service which does not include all mandatory fees or charges. 23
3737 (b) Misrepresents the source, sponsorship, approval, or 24
3838 certification of goods or services. 25

5151 (c) Fails to include on all relevant merchandise the 26
5252 statement "plus tax and fees" or a substantially similar 27
5353 statement, if amounts due for use as tax and fees are not 28
5454 included in the payments. 29
5555 (d) Makes false or misleading statements of fact relating 30
5656 to price reductions. 31
5757 (e) Represents that a transaction confers or involves 32
5858 rights, remedies, or obligations that it does not confer or that 33
5959 are prohibited by law. 34
6060 (f) Represents that the consumer will receive a rebate, 35
6161 discount, or other economic benefit, if such benef it is 36
6262 contingent upon the occurrence of an event subsequent to the 37
6363 completion of the transaction. 38
6464 (g) Misrepresents the authority of a salesperson, 39
6565 representative, or agent in negotiations with a consumer. 40
6666 (2) This subsection shall be enforced pursuant to ss. 41
6767 501.206-501.2075. 42
6868 Section 2. This act shall take effect July 1, 2025. 43
