chart of the Criminal Punishment Code; providing 59

Be It Enacted by the Legislature of the State of Florida: 62 
 63 
 Section 1.  Effective Ju ly 1, 2025, section 16.717, Florida 64 
Statutes, is created to read: 65 
 16.717  Florida Gaming Control Commission; authority to 66 
purchase and acquire property. —The Florida Gaming Control 67 
Commission is specifically exempt from chapter 255 and may 68 
purchase, lease, exchange, or otherwise acquire any land, 69 
property interests, buildings, or other improvements, including 70 
personal property within such buildings or on such lands that is 71 
necessary to or useful in securing or storing seized slot 72 
machines or any other contr aband. The property shall be held in 73 
the name of the state. 74 
 Section 2.  Section 843.08, Florida Statutes, is amended to 75

 843.08  False personation. —A person who falsely assumes or 77 
pretends to be a firefighter, a sheriff, an officer of the 78 
Florida Highway Patrol, an officer of the Fish and Wildlife 79 
Conservation Commission, an officer of the Department of 80 
Environmental Protection, an officer of the Department of 81 
Financial Services, any personnel or representative of the 82 
Division of Investigative and Forensic Services, an officer of 83 
the Department of Corrections, a correctional probation officer, 84 
a deputy sheriff, a state attorney or an assistant state 85 
attorney, a statewide prosecutor or an assistant statewide 86 
prosecutor, a state attorney investigator, a coroner, a police 87 
officer, a lottery special agent or lottery investigator, a 88 
beverage enforcement agent, any personnel or representative of 89 
the Florida Gaming Control Commission, a school guardian as 90 
described in s. 30.15(1)(k), a security officer lice nsed under 91 
chapter 493, any member of the Florida Commission on Offender 92 
Review or any administrative aide or supervisor employed by the 93 
commission, any personnel or representative of the Department of 94 
Law Enforcement, or a federal law enforcement officer as defined 95 
in s. 901.1505, and takes upon himself or herself to act as 96 
such, or to require any other person to aid or assist him or her 97 
in a matter pertaining to the duty of any such officer, commits 98 
a felony of the third degree, punishable as provided in s. 99 
775.082, s. 775.083, or s. 775.084. However, a person who 100

falsely personates any such officer during the course of the 101 
commission of a felony commits a felony of the second degree, 102 
punishable as provided in s. 775.082, s. 775.083, or s. 775.084. 103 
If the commission of the felony results in the death or personal 104 
injury of another human being, the person commits a felony of 105 
the first degree, punishable as provided in s. 775.082, s. 106 
775.083, or s. 775.084. In determining whether a defendant has 107 
violated this section, the court or jury may consider any 108 
relevant evidence, including, but not limited to, whether the 109 
defendant used lights in violation of s. 316.2397 or s. 843.081. 110 
 Section 3.  Section 849.01, Florida Statutes, is amended to 111 
read: 112 
 849.01  Keeping gambling houses, etc. —A person who Whoever 113 
by herself or himself, her or his servant, clerk or agent, or in 114 
any other manner has, keeps, exercises or maintains a gaming 115 
table or room, or gaming implements or apparatus, or house, 116 
booth, tent, shelter or ot her place for the purpose of gaming or 117 
gambling or in any place of which she or he may directly or 118 
indirectly have charge, control or management, either 119 
exclusively or with others, procures, suffers or permits any 120 
person to play for money or other valuable thing at any game 121 
involving any chance in winner determination whatever, whether 122 
heretofore prohibited or not, commits a felony misdemeanor of 123 
the third second degree, punishable as provided in s. 775.082 , 124 
or s. 775.083, or s. 775.084. 125

 Section 4.  Section 849.03, Florida Statutes, is amended to 126 
read: 127 
 849.03  Renting house for gambling purposes. —A person who 128 
Whoever, whether as owner or agent, knowingly rents to another a 129 
house, room, booth, tent, shelter or place for the purpose of 130 
gambling commits a f elony of the second degree, punishable as 131 
provided in s. 775.082, s. 775.083, or s. 775.084 gaming shall 132 
be punished in the manner and to the extent mentioned in s. 133 
849.01. 134 
 Section 5.  Section 849.04, Florida Statutes, is amended to 135 
read: 136 
 849.04  Permitting minors and persons under guardianship to 137 
gamble.— 138 
 (1) The proprietor, owner, or keeper of any E. O., keno or 139 
pool table, or billiard table, wheel of fortune, or other game 140 
of chance kept for the purpose of betting, who willfully and 141 
knowingly allows a minor or person who is mentally incompetent 142 
or under guardianship to play at such game or to bet on such 143 
game of chance; or whoever aids or abets or otherwise encourages 144 
such playing or betting of any money or other valuable thing 145 
upon the result of su ch game of chance by a minor or person who 146 
is mentally incompetent or under guardianship, commits a felony 147 
of the second third degree, punishable as provided in s. 148 
775.082, s. 775.083, or s. 775.084. 149 
 (2) For the purpose of this section, the term "person who 150

is mentally incompetent" means a person who because of mental 151 
illness, intellectual disability, senility, excessive use of 152 
drugs or alcohol, or other mental incapacity is incapable of 153 
managing his or her property or caring for himself or herself or 154 
both. 155 
 Section 6. Section 849.07, Florida Statutes, is repealed. 156 
 Section 7.  Section 849.09, Florida Statutes, is amended to 157 
read: 158 
 849.09  Lottery prohibited; exceptions. — 159 
 (1)  It is unlawful for any person in this state to: 160 
 (a)  Set up, promote, or conduct any lottery for money or 161 
for anything of value; 162 
 (b)  Dispose of any money or other property of any kind 163 
whatsoever by means of any lottery; 164 
 (c)  Conduct any lottery drawing for the distribution of a 165 
prize or prizes by lot or chance, or advertise any such lottery 166 
scheme or device in any newspaper or by circulars, posters, 167 
pamphlets, radio, telegraph, telephone, or otherwise; 168 
 (d)  Aid or assist in the setting up, promoting, or 169 
conducting of any lo ttery or lottery drawing, whether by 170 
writing, printing, or in any other manner whatsoever, or be 171 
interested in or connected in any way with any lottery or 172 
lottery drawing; 173 
 (e)  Attempt to operate, conduct, or advertise any lottery 174 
scheme or device; 175

 (f)  Have in her or his possession any lottery wheel, 176 
implement, or device whatsoever for conducting any lottery or 177 
scheme for the disposal by lot or chance of anything of value; 178 
 (g)  Sell, offer for sale, or transmit, in person or by 179 
mail or in any other mann er whatsoever, any lottery ticket, 180 
coupon, or share, or any share in or fractional part of any 181 
lottery ticket, coupon, or share, whether such ticket, coupon, 182 
or share represents an interest in a live lottery not yet played 183 
or whether it represents, or has represented, an interest in a 184 
lottery that has already been played; 185 
 (h)  Have in her or his possession any lottery ticket, or 186 
any evidence of any share or right in any lottery ticket, or in 187 
any lottery scheme or device, whether such ticket or evidence of 188 
share or right represents an interest in a live lottery not yet 189 
played or whether it represents, or has represented, an interest 190 
in a lottery that has already been played; 191 
 (i)  Aid or assist in the sale, disposal, or procurement of 192 
any lottery ticket, cou pon, or share, or any right to any 193 
drawing in a lottery; 194 
 (j)  Have in her or his possession any lottery 195 
advertisement, circular, poster, or pamphlet, or any list or 196 
schedule of any lottery prizes, gifts, or drawings; or 197 
 (k)  Have in her or his possession any so-called "run down 198 
sheets," tally sheets, or other papers, records, instruments, or 199 
paraphernalia designed for use, either directly or indirectly, 200

in, or in connection with, the violation of the laws of this 201 
state prohibiting lotteries and gambling. 202 
 203 
Provided, that nothing in this chapter does not section shall 204 
prohibit participation in any statewide or nationally advertised 205 
game promotion, contest, drawing, game or puzzle of skill or 206 
chance for a prize or prizes unless it can be construed as a 207 
lottery under this section ; and, provided further, that this 208 
exemption for national contests shall not apply to any such 209 
contest based upon the outcome or results of any horserace, 210 
harness race, dograce, or jai alai game . 211 
 (2)  A Any person who is convicted of v iolating any of the 212 
provisions of paragraph (1)(a), paragraph (1)(b), paragraph 213 
(1)(c), or paragraph (1)(d) commits of subsection (1) is guilty 214 
of a felony of the second third degree, punishable as provided 215 
in s. 775.082, s. 775.083, or s. 775.084. 216 
 (3)(a) Except as provided in paragraph (b), a Any person 217 
who is convicted of violating any of the provisions of paragraph 218 
(1)(e), paragraph (1)(f), paragraph (1)(g), paragraph (1)(i), or 219 
paragraph (1)(k) commits of subsection (1) is guilty of a felony 220 
misdemeanor of the third first degree, punishable as provided in 221 
s. 775.082, or s. 775.083, or s. 775.084. 222 
 (b)  A Any person who commits a second or subsequent 223 
violation of paragraph (a) commits , having been convicted of 224 
violating any provision thereof, thereafter violates any 225

provision thereof is guilty of a felony of the second third 226 
degree, punishable as provided in s. 775.082, s. 775.083, or s. 227 
775.084. 228

bingo as provided for in s. 849.0931. 231 
 (4)(a)  Except as provided in paragraph (b), a Any person 232 
who is convicted of violating any of the provisions of paragraph 233 
(1)(h) or paragraph (1)(j) commits of subsection (1) is guilty 234 
of a felony misdemeanor of the third first degree, punishable as 235 
provided in s. 775.082, or s. 775.083, or s. 775.084. 236 
 (b) A Any person who commits a second or subsequent 237 
violation of paragraph (a) commits , having been convicted of 238 
violating any provision thereof, thereafter violates any 239 
provision thereof is guilty of a felony of the second third 240 
degree, punishable as provided in s. 775.082, s. 775.083, or s. 241 
775.084. 242 
 Section 8.  Paragraph (f) of subsection (1) and paragraph 243 
(a) of subsection (2) of section 849.0931, Florida Statutes, are 244 
amended, and subsection (13) of that sec tion is republished, to 245 
read: 246 
 849.0931  Bingo authorized; conditions for conduct; 247 
permitted uses of proceeds; limitations. — 248 
 (1)  As used in this section: 249 
 (f)  "Instant bingo" means a form of bingo that is played 250

at the same location as bingo, using physical or electronic 251 
tickets by which a player wins a prize by physically or 252 
electronically opening and removing a cover from the ticket to 253 
reveal a set of numbers, letters, objects, or patterns, some of 254 
which have been designated in advance as prize winners . 255 
 (2)(a)  None of the provisions of this chapter or other 256 
laws of this state shall be construed to prohibit or prevent 257 
charitable, nonprofit, or veterans' organizations engaged in 258 
charitable, civic, community, benevolent, religious, or 259 
scholastic works or other similar endeavors, which organizations 260 
have been in existence and active for a period of 3 years or 261 
more, from conducting bingo games or instant bingo, provided the 262 
entire proceeds derived from the conduct of such games, less 263 
actual business expense s for articles designed for and essential 264 
to the operation, conduct, and playing of bingo or instant 265 
bingo, are donated by such organizations to the endeavors 266 
mentioned above. In no case may the net proceeds from the 267 
conduct of such games be used for any o ther purpose whatsoever. 268 
The proceeds derived from the conduct of bingo games or instant 269 
bingo shall not be considered solicitation of public donations. 270 
 (13)(a)  Instant bingo tickets must be sold at the price 271 
printed on the ticket or on the game flare by the manufacturer, 272 
not to exceed $1. Discounts may not be given for the purchase of 273 
multiple tickets, nor may tickets be given away free of charge. 274 
 (b)  Each deal of instant bingo tickets must be accompanied 275

by a flare, and the flare must be posted before the sale of any 276 
tickets in that deal. 277 
 (c)  Each instant bingo ticket in a deal must bear the same 278 
serial number, and there may not be more than one serial number 279 
in each deal. Serial numbers printed on a deal of instant bingo 280 
tickets may not be repeated by the manufacturer on the same form 281 
for a period of 3 years. 282 
 (d)  The serial number for each deal must be clearly and 283 
legibly placed on the outside of each deal's package, box, or 284 
other container. 285 
 (e)  Instant bingo tickets manufactured, sold, or 286 
distributed in this state must comply with the applicable 287 
standards on pull-tabs of the North American Gaming Regulators 288 
Association, as amended. 289 
 (f)  Except as provided under paragraph (e), an instant 290 
bingo ticket manufactured, sold, or distributed in this sta te 291 
must: 292 
 1.  Be manufactured so that it is not possible to identify 293 
whether it is a winning or losing instant bingo ticket until it 294 
has been opened by the player as intended. 295 
 2.  Be manufactured using at least a two -ply paper stock 296 
construction so that t he instant bingo ticket is opaque. 297 
 3.  Have the form number, the deal's serial number, and the 298 
name or logo of the manufacturer conspicuously printed on the 299 
face or cover of the instant bingo ticket. 300

 4.  Have a form of winner protection that allows the 301 
organization to verify, after the instant bingo ticket has been 302 
played, that the winning instant bingo ticket presented for 303 
payment is an authentic winning instant bingo ticket for the 304 
deal in play. The manufacturer shall provide a written 305 
description of the winner protection with each deal of instant 306 
bingo tickets. 307 
 (g)  Each manufacturer and distributor that sells or 308 
distributes instant bingo tickets in this state to charitable, 309 
nonprofit, or veterans' organizations shall prepare an invoice 310 
that contains the following information: 311 
 1.  Date of sale. 312 
 2.  Form number and serial number of each deal sold. 313 
 3.  Number of instant bingo tickets in each deal sold. 314 
 4.  Name of distributor or organization to whom each deal 315 
is sold. 316 
 5.  Price of each deal sold. 317 
 318 
All information contained on an invoice must be maintained by 319 
the distributor or manufacturer for 3 years. 320 
 (h)  The invoice, or a true and accurate copy thereof, must 321 
be on the premises where any deal of instant bingo tickets is 322 
stored or in play. 323 
 Section 9.  Subsections (3) and (4) of section 849.10, 324 
Florida Statutes, are amended, and subsections (1) and (2) of 325

that section are republished, to read: 326 
 849.10  Printing lottery tickets, etc., prohibited. — 327 
 (1)  Except as otherwise provided by law, it is unl awful 328 
for any person, in any house, office, shop or building in this 329 
state to write, typewrite, print, or publish any lottery ticket 330 
or advertisement, circular, bill, poster, pamphlet, list or 331 
schedule, announcement or notice, of lottery prizes or drawings 332 
or any other matter or thing in any way connected with any 333 
lottery drawing, scheme or device, or to set up any type or 334 
plate for any such purpose, to be used or distributed in this 335 
state, or to be sent out of this state. 336 
 (2)  Except as otherwise provided by law, it is unlawful 337 
for the owner or lessee of any such house, shop or building 338 
knowingly to permit the printing, typewriting, writing or 339 
publishing therein of any lottery ticket or advertisement, 340 
circular, bill, poster, pamphlet, list, schedule, annou ncement 341 
or notice of lottery prizes or drawings, or any other matter or 342 
thing in any way connected with any lottery drawing, scheme or 343 
device, or knowingly to permit therein the setting up of any 344 
type or plate for any such purpose to be used or distributed in 345 
this state, or to be sent out of the state. 346 
 (3)  Nothing in This chapter does not shall make unlawful 347 
the printing or production of any advertisement or any lottery 348 
ticket for a lottery conducted in any other state or nation 349 
where such lottery is not prohibited by the laws of such state 350

or nation, or the sale of such materials by the manufacturer 351 
thereof to any person or entity conducting or participating in 352 
the conduct of such a lottery in any other state or nation. This 353 
section does not authorize any advertisement within Florida 354 
relating to lotteries of any other state or nation, or the sale 355 
or resale within Florida of such lottery tickets, chances, or 356 
shares to individuals, or any other acts otherwise in violation 357 
of any laws of the state. 358 
 (4)  A Any violation of this section is shall be a felony 359 
of the second third degree, punishable as provided in s. 360 
775.082, s. 775.083, or s. 775.084. 361 
 Section 10.  Section 849.105, Florida Statutes, is created 362 
to read: 363 
 849.105  Gambling advertising prohibited. — 364 
 (1)  Except as otherwise provided by law, it is unlawful 365 
for any person to write, typewrite, print, publish, or 366 
disseminate in any way, any advertisement, circular, bill, 367 
poster, pamphlet, list, schedule, announcement, or notice, 368 
either of any illegal ga mbling operation or of any other matter 369 
in any way either related to or connected with illegal gambling. 370 
Further, it is unlawful to set up any type or plate for any type 371 
of advertisement in any way connected with illegal gambling, to 372 
be used or distributed in this state, or to be sent out of this 373 
state. 374 
 (2)  Except as otherwise provided by law, it is unlawful 375

for the owner or lessee of any house, office, shop, building, or 376 
any other establishment of any kind in this state to knowingly 377 
permit the printing, typewriting, writing, publishing, or any 378 
other dissemination of any sort of any advertisement, circular, 379 
bill, poster, pamphlet, list, schedule, announcement, or notice 380 
of any activity in any way related to or connected with illegal 381 
gambling. Further, it i s unlawful to knowingly permit the 382 
setting up of any type of plate for any such purpose to be used 383 
or distributed in this state, or to be sent out of the state. 384 
 (3)  This section does not: 385 
 (a)  Prohibit the printing or production of any 386 
advertisement for gambling conducted in any other state or 387 
nation where such gambling is not prohibited by the laws of such 388 
state or nation, or the sale of such materials by the 389 
manufacturer thereof to any person or entity conducting or 390 
participating in the conduct of such gambling in any other state 391 
or nation. 392

 (b)  Secure additional chances or rights to use such 514 
machine, apparatus, or device, even though the device or system 515 
may be available for free play or, in addition to any element of 516 
chance or unpredictable outco me of such operation , may also 517 
sell, deliver, or present some merchandise, indication of 518 
weight, entertainment, or other thing of value. The term "slot 519 
machine or device" includes, but is not limited to, devices 520 
regulated as slot machines pursuant to chapt er 551, but does not 521 
include devices designated as amusement devices under chapter 522 
446 or devices used in play of bingo or instant bingo under s. 523

applied to the possession of a reverse vend ing machine. As used 526 
in this section, the term "reverse vending machine" means a 527 
machine into which empty beverage containers are deposited for 528 
recycling and which provides a payment of money, merchandise, 529 
vouchers, or other incentives. At a frequency less than upon the 530 
deposit of each beverage container, a reverse vending machine 531 
may pay out a random incentive bonus greater than that 532 
guaranteed payment in the form of money, merchandise, vouchers, 533 
or other incentives. The deposit of any empty beverage conta iner 534 
into a reverse vending machine does not constitute 535 
consideration, and a reverse vending machine may not be deemed a 536 
slot machine as defined in this section. 537 
 (3)  There is a rebuttable presumption that a device, 538 
system, or network is a prohibited slot machine or device if it 539 
is used to display images of games of chance and is part of a 540 
scheme involving any payment or donation of money or its 541 
equivalent and awarding anything of value. 542 
 Section 16. Section 849.23, Florida Statutes, is repealed. 543

 (b)  The following factor s shall be considered in making a 554 
determination that a person has engaged in the offense of 555 
bookmaking: 556 
 1.  Taking advantage of betting odds created to produce a 557 
profit for the bookmaker or charging a percentage on accepted 558 
wagers. 559 
 2.  Placing all or part of accepted wagers with other 560 
bookmakers to reduce the chance of financial loss. 561 
 3.  Taking or receiving more than five wagers in any single 562 
day. 563 
 4.  Taking or receiving wagers totaling more than $500 in 564 
any single day, or more than $1,500 in any si ngle week. 565 
 5.  Engaging in a common scheme with two or more persons to 566 
take or receive wagers. 567 
 6.  Taking or receiving wagers on both sides on a contest 568 
at the identical point spread. 569 
 7.  Any other factor relevant to establishing that the 570 
operating procedures of such person are commercial in nature. 571 
 (c)  The existence of any two factors listed in paragraph 572 
(b) may constitute prima facie evidence of a commercial 573 
bookmaking operation. 574 
 (2)  A Any person who engages in bookmaking commits shall 575

Notwithstanding the provisions of s. 948.01, a any person 578 
convicted under the provisions of this subsection may shall not 579 
have adjudication of guilt suspended, deferred, or withheld. 580 
 (3)  A Any person who commits a second or subsequent 581 
violation has been convicted of bookmaking and thereafter 582 
violates the provisions of this section commits shall be guilty 583 
of a felony of the second degree, punishable as provided in s. 584 
775.082, s. 775.083, or s. 775.084. Notwithstanding the 585 
provisions of s. 948.01, a any person convicted under the 586 
provisions of this subsection may shall not have adjudication of 587 
guilt suspended, deferred, or withheld. 588 
 (4)  Notwithstanding the provisions of s. 777.04, a any 589 
person who commits is guilty of conspiracy to commit bookmaking 590 
shall be subject to the penalties imposed by subsections (2) and 591 
(3). 592 
 (5)  This section does shall not apply to pari-mutuel 593 
wagering in Florida as authorized under chapter 550. 594 
 (6)  This section shall not apply to any prosecutions filed 595 
and pending at the time of the passage hereof, but all such 596 
cases shall be disposed of under existing laws at the time of 597 
the institution of such prosecutions. 598

 (2)(a)  Except as otherwise specifically authorized by law, 606 
a person may not knowingly and intentionally make, publish, 607 
disseminate, circulate, or place before the public, or cause, 608 
directly or indirectly, to be made, published, disseminated, 609 
circulated, or placed before the public in this state, in any 610 
manner, whether in person or by the use, at least in part, of 611 
the Internet, any advertisement, circular, bill, poster, 612 
pamphlet, list, schedule, announcement, or notice for the 613 
purpose of promoting or facilitating illegal gambling. 614 
 (b)  Except as otherwise specifically authorized by law, a 615 
person may not set up any type or plate for any type of 616 
advertisement, circular, bill, poster, pamphlet, list, schedule, 617 
announcement, or notice when he or she knows or reasonably 618 
should know that such material will be used for the purpose of 619 
promoting or facilitating illegal gambling. 620 
 (c)  A person who violates this section commits a felony of 621 
the third degree, punishable as provided in s. 775.082 or s. 622 
775.083. 623 
 (d)  This section does not prohibit advertising of bingo or 624 
instant bingo by tax -exempt organizations authorized to conduct 625

appearance bond, particularly whether the proffered funds, real 637 
property, property, or any proposed collateral or bond premium 638 
may be linked to or derived from the crime alleged to have been 639

substance, a slot machine, or any type of illegal gambling or 641 
gaming, or from any other criminal or illicit activities. The 642 
burden of establishing the noninvolvement in or nonderivation 643 
from criminal or other illicit activity of such proffered funds, 644 
real property, property, or any proposed collateral or bond 645 
premium falls upon the defendant or other person proffering them 646 
to obtain the defendant's release. 647 
 (i)  The amount of currency seized that is connected either 648 
directly or indirectly to any violati on of chapter 550, chapter 649 
551, or chapter 849. It is the finding of the Legislature that 650

and that frequently such defendants are able to post monetary 654 
bail using the proceeds of their unlawful enterprises to defeat 655 
the social utility of pretrial bail. It is the intent of the 656 
Legislature that courts be required to carefully con sider the 657 
utility and necessity of substantial bail in relation to the 658 
amount of proceeds a defendant has obtained from any violation 659 
of chapter 550, chapter 551, or chapter 849. 660
